REMOVAL OF LESSEE’S EQUIPMENT AND PERSONAL PROPERTY Form 1. The removal of all personal property, equipment, and fixtures of Lessee, including casing, shall be completed within (Specify Time Period) following the expiration or term ination of this Lease. Lessee’s failure to remove all property, equipment, and fixtures within that period of time shall constitute and be deemed a complete abandonment by Lessee of the property, equipment, and fixtures, as if the same had been transferred or conveyed to Lessor. On abandonment, the property, equipment and fixtures shall be owned by Lessor, free of cost, and with Lessee having no right of restitution, or title to the property, equipment and fixtures. Form 2. Lessee has the right to remove all of its machinery, equipment, and fixtures located on the lease premises, including the right to withdraw and remove all casing, up to the date of the expiration of the primary term of this Lease and for a period of ____ days after the termina tion of this Lease, if it has been perpetuated beyond its primary term. From and after that date all machinery, equipment and fixtures located on the lease premises shall be deemed owne d by Lessor. Form 3. Lessee’s right to remove property, equipment, fixtures, and casing is conditioned on the proper plugging by Lessee (or its successors, assigns, agents or contractors) of any dry holes or abandoned wells on the lease premises. This removal right shall terminate if the property, equipment, fixtures, and casing are not removed within ____ days after the termination of this Lease. After the expiration of this ____ day period any of Lessee’s property remaining on the lease premises shall become the property of and owned by Lessor without any requirement tha t Lessee be reimbursed for the value of any property, equipment, fixtures, and casing. Form 4. Lessee has the right to remove all property, equipment, and fixtures (including casing) placed on the lease premises by Lessee, except for all installed cattle gua rds and gates which are to remain on the lease premises and be owned by Lessor. Lessee may remove all ca sing during the term of this Lease or within ____ days after the termination of this Lease. Howe ver, if Lessee does not remove its property from the lease premises in a timely manner, a ll of the property, equipment, fixtures and casing shall become the property of Lessor. Form 5. Lessee has the right at any time during the primary term of this Lease or within ____ days after the expiration of the primary term of this Lease to remove all of its recoverable casing (except water well casing), machinery and fixtures. If Lessee fails to remove it s property within the ____ day period, title to it shall become vested automatically in Lessor, free of all liens. On commencement of drilling operations on the lease premises, Lessee shall purchase a performance bond of sufficient amount to enable Lessor to remove, without cost, any personal property, equipment, and casing which remains on the lease premises after the ____ day period foll owing the expiration of the Lease.
