INTERROGATORIES TO:

Defendant
________________________________________________________________________________CV8DD
The party whose attorney subscribes propounds the attached Interrogat ories. RCP 33. If the party served is a
public or private corporation, a partnership or association, or governmental agency, these Interrogatories shall
be answered by any officer or agent, who shall furnish such information as is available to the party. Each
interrogatory shall be answered separately and fully in writing under oath unless it is objected to, in which event
the reasons for objection shall be stated in lieu of an answer. The answers are to be signed by the person
making them, and the objec tions signed by the attorney making them. The party upon whom the interrogatories
have been served shall serve a copy of the answers and objections, if any, within 40 days after the service of the
Interrogatories, except that a Defendant may serve answers or objections within 60 days after service of the
Summons and Complaint upon that Defendant.
Where the answer to an interrogatory may be derived or ascertained from the business records of the party upon
whom the interrogatory has been served or from an examination, audit or inspection of such business records, or
from a compilation, abstract or summary based thereon, and the burden of deriving or ascertaining the answer is
substantially the same for the party serving the interrogatory as for the party s erved, it is a sufficient answer to
such interrogatory to specify the records from which the answer may be derived or ascertained and to afford the
party serving the interrogatory reasonable opportunity to examine, audit or inspect such records and to make
copies, compilations, abstracts or summaries.
The answers to these interrogatories shall include the knowledge of the parties to whom these interrogatories are
directed, their attorneys, and all agents, servants, representatives, investigators and others who may have
obtained information on behalf of the parties or their attorneys. If the parties served with Interrogatories fail to
properly serve answers, then the propounding party may apply for those sanctions set forth in RCP 37,
including reasonable a ttorneys' fees.
Each party to whom these Interrogatories are directed is required seasonably to supplement his response with
respect to any question directly addressed to the identity and location of persons having knowledge of
discoverable matters and th e identity of each person expected to be called as an expert witness at the trial, the
subject matter on which he is expected to testify and the substance of his testimony. Each party to whom these
Interrogatories are directed is required seasonably to am end a prior response if he obtains information on the
basis of which he knows that the response was incorrect when made or he knows that the response, though
correct when made, is no longer true and the circumstances are such that a failure to amend a resp onse is in
substance knowing concealment.
Where and individual interrogatory calls for an answer which involves more than one part, each part of the
answer should be clearly set out so that it is understandable.
Where the terms "you", "plaintiff", "defendant" or other designation for a party are used, they are meant to
include every individual party and separate answers should be given for each party named as a party, if
requested.
