21.01[10] Lease Modification Adding One or More Entities as Tenant PartiesLandlord and Tenant agree that the Lease [Sublease] is hereby modified as follows: 1. [New Tenant] is hereby incorporated and included in the Lease [Sublease] as cotenant on an equal basis with [Original Tenant], and the grant and acceptance of undivided equal shares of the leasehold [subleasehold] interest under the Lease [Sublease] and the demise and acceptance of the Demised Premises are made to and by [Original Tenant] and [New Tenant] as cotenants, in the same manner, to the same extent, and effective as of the same date as if made originally upon the execution and delivery of the Lease [Sublease] by Landlord and [Original Tenant], all upon the same terms, provisions, and conditions as contained in the Lease [Sublease], as modified by this Modification Agreement. In amplification, and not in limitation, of the foregoing, [New Tenant] makes the same covenants, warranties, and representations, agrees to the same indemnities, and is entitled to receive the same rights and benefits specified in the Lease [Sublease] as [Original Tenant], and [Original Tenant] and [New Tenant] are jointly and severally obligated for all of the obligations of Tenant under the Lease [Sublease], as modified by this Modification Agreement. To the extent, if any, required by law to make such cotenancy effective, the following grant is made anew: Landlord does hereby lease to [Original Tenant] and [New Tenant], as cotenants (collectively Tenant), and Tenant does hereby hire and take from Landlord the Demised Premises for a term commencing as of [insert appropriate defining information] (Commencement Date) and ending on _______________, 200_ (Expiration Date) unless such term shall sooner terminate as provided in the Lease [Sublease], as modified by this Modification Agreement. The Modification Agreement must be signed by the original and the new tenant parties.
