Lease for Storage of Goods This lease is hereby entered into by and between       , (Name of XYZ Storage, Inc.) a corporation organized and existing under the laws of the state of       , (Name of State) with its principal office located at       , referred to (Street Address, City, County, State, Zip Code) herein as, Lessor, and       , the Lessee, of (Name of Lessee)       , as of the       day of       , (Street Address, City, County, State, Zip Code) 20       . For and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the parties agree as follows: 1. Lessor hereby leases unto Lessee, Space Number       , Size       , (number or letter) (e.g., square feet) hereafter sometimes referred to as the Premises to be used as a storage space for storing personal property beginning on the       day of       , 20       , for a month to month term. Lessee may not, under any circumstances, store explosive, toxic and/or highly flammable or hazardous materials and/or goods. 2. The Lessee agrees to Lessor the sum of $       per month, in advance on the first day of each month as rent for the use of said storage space. There will be no refund of rents for any reason. This Lease shall be automatically extended on the first of each month unless terminated according to Section 9 below. 3. This Lease may not be assigned nor the Premises subleased without the written permission of Lessor. 4. Lessor shall have the right at all times to enter the Premises to view the same and make repairs, and to ascertain whether the Lessee is in compliance with the terms of this Lease. 5. In the event of a default in the payment of rent, or any other default under this Lease, Lessor may, at its option and without previous notice, enter and repossess the premises and, as set forth in Paragraph 7, shall have a lien on all property in said storage space, for the payment of rent and expenses of re-entry. 6. It is agreed and understood that it is the responsibility of the Lessee to assume the sole risk of loss for all physical damage to his, her, or their property stored, kept, or maintained on, in or around said Premises against such risks including, but not limited to fire, lightening, smoke, perils of windstorm, hail, explosion, burglary, robbery, theft, damage by freezing, extreme high temperatures, water, rodents, or insects, any acts of God or otherwise. Lessor also shall not be liable for any such losses due in whole or in part to conditions, acts or omissions done or permitted by the Lessee, and Lessor shall not be responsible to Lessee, his invitees, agents or Lease for Storage of Goods Page 1 of 3 employees for damage to any person or property caused by the above. Lessee agrees to indemnify and hold Lessor harmless of and from any such damage, loss, cost, or expenses. Any insurance which may be carried by the Lessor and Lessee against any loss or damage to the building or its contents and other improvements situated on the demised premises shall be for the sole benefit of the parties carrying such insurance. Lessee further agrees to indemnify Lessor and hold him harmless from any loss, expense and/or claims arising any loss or damage that may be occasioned by or through any act or omission of Lessee. 7. In addition to such liens and remedies provided by law to secure and collect rent, Lessor is hereby given a lien upon all of the Lessee’s property, now or at any time hereafter stored on, in, or around said Premises, and in case of default in payment of said rent by Lessee, Lessor is authorized to seize and take possession of said property and place Lessor’s lock on the doors of said leased premises , and after due notice to Lessee, if the rent is not paid within the time specified in said notice, sell said property at public or private sale, for the payment of said rent. From the proceeds of such sale, Lessor shall satisfy his lien and the reasonable costs of such sale. The balance, if any, of such proceeds, shall be paid to Lessee. Said notice shall be in writing and shall be delivered in person or by certified letter addressed to the last known address of Lessee on record with Lessee, and shall contain a demand for the payment of said rent. The requirement of reasonable notice shall be met by the mailing of said notice, postage prepaid to the said address of Lessee at least five days prior to date of sale or disposition. 8. Lessor or its designated agent may enter said storage space at any time to inspect, repair, and/or maintain said space, and if necessary, in the opinion of Lessor, the contents of Lessee in such space may be moved to another storage room or suitable storage facility during such inspection, repair, and/or maintenance. 9. Either party hereto may terminate this agreement effective on any rental payment date by giving notice to the other in writing       day(s) prior to such date.
