Furthermore, Customer covenants not to sue Servicer or any of Servicer’s employees and agrees in advance to release, waive, and forever discharge Servicer or any of Servicer’s employees against any and all liability for any harm, injury, damage, claims, demands, actions, causes of action, costs, and expenses of any nature that may result from service, maintenance and/or repair services Customer accepts from Servicer. 2. In signing this Release, Customer acknowledges and represents that he has been fully informed of the content of the foregoing waiver of liability agreement by reading it before he signed it, and he understands that he is signing this document as his own free act and deed. 3. No oral representations, statements, or inducements, apart from the foregoing written statements, have been made to customer. Customer further states that he is at least eighteen (18) years of age and fully competent to sign this Agreement. 4. Mandatory Arbitration: Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. 5.
