RELEASE FROM LIABILITY BY PARENT/GUARDIAN FOR STUDENTS UNDER THE AGE OF 18 TO PARTICIPATE IN ON-SITE DANCE, GYMNASTICS AND YOGA CLASSES Waiver and Release Agreement given to ___________, d/b/a ______________________, of ________________________________________ (street address, city, county, state, zip code) , referred to herein as ______________ , by the undersigned Parent/Guardian of preschool participant. Whereas, ____________ owns and operates an on-site preschool enrichment program ( hereinafter referred to as Program) which provides dance, gymnastics and/or yoga classes for preschoolers; and Whereas, the undersigned Parent/Guardian of _____________________ (name of child), hereafter referred to a Child, desires for Child to participate in Program; Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Parent/Guardian agree as follows: The undersigned Parent/Guardian of Child hereby give permission for Child to attend and participate in all classes and activities of _______________ at the following locations: _______________________________________________________________________ _______________________________________________________________________ _______________________________________________________________________. As a condition of Child being allowed to attend and participate in such classes and activities, I/We hereby release _________ , its directors, agents, officers, and employees (hereinafter jointly and severally referred to as __________ ) from any liability which may or could occur by reason of any personal injury or property damage suffered by Child , regardless of the cause or alleged cause of such personal injury or property damage as a result of the participation of Child in Program. The undersigned understand(s) that Child will be voluntarily participating in activities (including, but not limited to dance instruction, gymnastics and/or yoga classes) which may expose him/her to some level of risk or injury and the undersigned represent(s) that I/we are aware of the nature of these activities and agree to accept any and all risks associated with the participation of Child in these activities. The undersigned represent(s) that Child is in good physical health and agree that unless I/we have notified _________________ in writing that Child is unable to participate in an activity due to some physical or mental considerations, he/she will be allowed to participate in all activities of the Program. Furthermore, in consideration of _____________ allowing Child to participate in the Program , I/we do agree to hold _____________ harmless against loss (including reasonable attorneys = fees) from any and all claims of ordinary negligence, demands, rights, or causes of actions of any kind or nature that may hereafter at any time be made or brought by Child or me/us on behalf of Child , for any known or unknown, foreseen and unforeseen bodily or personal injuries, damages to property and consequences thereof which may be sustained by Child as a direct or indirect result of participating in the aforementioned activities Program. Any dispute under this Release shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. CAUTION: READ BEFORE SIGNING By signing below, the undersigned acknowledge that I/we understand that I/we are entitled to have an attorney of our own choosing to review the release prior to signing. I/We have read the foregoing Release in its entirety and understand that I/we are signing a complete and perpetual release and bar to any and all claims of negligence as defined above resulting from the participation of Child in the Program.
