Copyright 2005 USLegalforms.com PARKING USER’S WAIVER OF CLAIMS ARISING FROM USE OF LAND FOR PARKING AND RELEASE OF PREMISES OWNER FROM LIABILITY In consideration of being allowed parking privileges on the below described premises so long as permitted by the owner of said premises named herein, I, ________________________, HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge ________________________ [landowner] from any and all claims, demands, debts, contracts, expenses, causes of action, la wsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, tha t I ever had or may have, arising from or in any way related to my parking activities on the premises of land owned by ________________________ [landowner] in the County of ________________________, in the State of at the following address provided that this waiver of liability does not apply to any acts of gross negligence, or i ntentional, willful or wanton misconduct. I understand that the activity in which I will participate, because a moving ve hicle is involved, may be inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage t o personal property and/or death; and that injuries can also occur because of the condition of the land, and that the land may pose such dangerous conditions due to snakes, insects, spiders, ditches, erosi ons, sharp rocks, culverts, fallen trees, branches, snow, mud, darkness, poor visibility or any other natural or man- made hazards. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries and/or death sustained to me or my property that I may have against the aforem entioned released party. By this Waiver, I assume any risk, and take full responsibility and waive any claims of personal injury, death or damage to myself or my property, including but not limited to any potential claim involving or associated with parking on the land, using the land in any manner, or engaging in any act ivities, whether related to the purpose of this Agreement or not, both on and off the premises. This WAIVER AND RELEASE contains the entire agreement between the parties, and supercedes any prior written or oral agreements between them concerning the subject matter of thi s WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may not be waived, altered, amended or repealed, in whole or in part, except upon the prior written consent of all parties. I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I underst and and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, and in consideration of being allowed to park on t he subject premises. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or older, mentally competent to enter into this waiver, and under no duress. This agreement and its terms and provisions will include any minors and/or adults who accompany me or who are under my care.
