The Real Estate Non-Solicitation Ordinance Publication Date: 20 Ordinance No. specifies, in part: Section It shall be unlawful to solicit any owner to sell, rent, or list residential property at any time after such person has provided notice that such owner does not desire to sell, rent, or list such residential property. Section It shall be unlawful to engage in solicitation without first having met with the [Fair Housing Administrator] to briefly discuss the solicitation and its compliance with this ordinance...and provided the [Fair Housing Administrator] one copy of each brochure, letter, or other written or printed material to be shown, given or sent to any person solicited.and submitted to the [Fair Housing Administrator] on a form provided by the the following information: 1. The name, address, telephone number and real estate license number of each person who will be participating in the solicitation; 2. The general location to be solicited; 3. The time interval of solicitation; 4. The means of solicitation, e.g., written material by mail, written material left at door, telephone, personal visit to home, etc. Section Solicit or Solicitation means any communication by or on behalf of a real estate agent with the owner or occupant of a dwelling which is intended to induce the sale or rental of such dwelling, which is intended to offer or promote services in connection with the sale, rental or listing of such dwelling; and which is carried out by means of in-person contacts at the dwelling, written material mailed or deli vered directly to the dwelling, such as direct mail, leaflets or pamphlets; or telephone contacts with owners or occupants of the dwelling. For purposes of this Ordinance, the term "solicit" or "solicitation" shall not refer to communication carried out by means of print or electronic media of general circulation, such as a newspaper, radio, television, or the Yellow Pages, or similar telephone directory advertising. Section Any person violating this ordinance pertaining to non-solicitation shall be subject to a fine up to the amounts specified in the municipal Fair Housing Ordinance, Section . In addition, the [Fair Housing Administrator] may further direct that any violation of this chapter be brought before the Housing Practices Review Board as provided in Article of said ordinance.
