Pursuant to La. R.S. 9:371, Petitioner is requesting this Court to grant a temporary restraining order prohibiting either party from disposing of or encumbering the community property. Pursuant to La. R.S. 9:372 Petitioner is requesting that this Court grant a temporary restraining order prohibiting either party from harassing or physically abusing each other. Pursuant to La. R.S. 9:373, Petitioner is requesting that this Court grant an ex-parte order allowing the Petitioner to obtain his personal property consisting of personal wearing apparel, tools and furniture necessary for his well-being. Pursuant to La. R.S. 9:374, Petitioner is requesting that this Court award him the use of the _______________ Truck, as Petitioner is paying the truck note and all insurance associated therewith. Defendant has other transportation. Petitioner is also requesting that this court determine a fair rental value of the community home, as defendant is currently residing therein. La.R.S. 9:374 as interpreted by the case of McCarrol v. McCarrol , 701 So.2d 1280 (La. 1997) any rental claim must be bought at the time of the award of the use and occupancy of the property unless the spouses agree otherwise.
