BUILDING AGREEMENT THIS AGREEMENT is entered into by and between       , hereinafter "Owner", and       , hereinafter "Subcontractor". FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which is hereby acknowledged, Owner and Subcontractor do hereby covenant, contract and agree as follows: 1. Subcontractor agrees to perform the following work on a home to be constructed for Owner:       2. Subcontractor will be paid by Owner for the above described work in the following manner:       3. Subcontractor shall provide Owner with satisfactory proof of the following insurance coverages: (1) Public Liability and Property Damage Insurance with limits of not less than $       /$       Public Liability, $       /$       Property Damage and (2) Workers Compensation Coverage for subcontractors employees. 4. Subcontractor and Owner agree that Subcontractor is an independent contractor. Subcontractor agrees that Owner will not be responsible or liable for personal injuries to subcontractor or his employees. 5. Subcontractor agrees that all labor and materials purchased by him for use on owners residence shall be paid for in full prior to the payment by Owner to subcontractor and that subcontractor will indemnify and save owner harmless for the payment of same. Subcontractor acknowledges that none of his employees or independent contractors are employees of Owner and that no right exists for said persons to file a lien on Owners property. If liens are filed by said persons, Subcontractor agrees to defend same and have same canceled of record by payment or otherwise. 6. The subcontractor shall visit the site before submitting his proposal and acquaint himself with all conditions which govern the work under this contract. 7. The subcontractor shall abide by all building codes and ordinances of the City of       and       County, Mississippi even though the property is not located in the City limits. 8. The subcontractor shall keep the premises reasonably clean at all times and at the end of the job thoroughly clean all glass, light fixtures, hardware, brickwork and any and all surfaces which have been soiled during construction and shall remove all rubbish, trash and do any fine grading around the residence required for a satisfactory job. No burning or burying of trash will be permitted without consent of the Owner. 9. No change shall be made from the plans and specifications unless a written change order is signed by the Owner and Contractor. 10. Subcontractor warrants and guarantees all work, materials, equipment and accessories to be free from defects an acceptable for the purpose for which they are intended in a good and workmanlike manner.
