MISSISSIPPI PUBLIC SERVICE COMMISSION       , MISSISSIPPI No.             IN RE: APPLICATION OF       , FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY AUTHORIZING IT TO CONSTRUCT, OPERATE, AND MAINTAIN A WATER SYSTEM WITHIN A SPECIFIED AREA ADJACENT TO ITS PRESENT SERVICE AREA IN RANKIN COUNTY, MISSISSIPPI 0 R D E R THIS DAY this cause came on for hearing before the Mississippi Public Service Commission, and it appearing that all matters before the Board are right for adjudication, and that notice has been given to all necessary and proper parties, the Commission finds as follows: 1. On       ,       , filed a Petition for Certificate of Public Convenience and Necessity to operate a public utility rendering water service to the public pursuant to the provisions of Chapter 372, Laws of 1956, Regular Session of the Mississippi Legislature, usually called the Public Utilities Act of 1956, as amended. Pursuant to Rule 6J of the Public Utility Rules of Practice Procedure, notice of same was obtained as against the Town of       in       County, Mississippi, same being a code charter town. 2. On       , the Town of       filed a Petition in which it, inter alia , that Parcel 1 of the area for which the       (       ) desired to receive certification for the purposes of providing water service pursuant to a Certificate of Public Convenience and Necessity, same being an action to which the Town of       (       ) objected, insofar as was concerned Parcel 1. 3. That with regard to said Parcel 1,       and       have reached a satisfaction and accord which they wish to be incorporated into an Order of the Public Service Commission. 4. As is evidenced by the signature of counsel for       and       ,       and       agree with the adjudication of this Commission, viz: IT IS, THEREFORE, ORDERED: (1)       withdraws its Objection to       receiving a Certificate of Public Convenience and Necessity, and same is dismissed with prejudice, insofar and only insofar as the following portions of said Parcel 1 are concerned: Township North, Range East: Section : The SE 1/4 of SW 1/4; the North half of SW 1/4; the SE 1/4; Section : The South half SW 1/4; Section : The North half of NE 1/4; Section : The West half. (2)       in consideration of the withdrawal of the Objection by the Town of       , withdraws from its Petition before the Public Service Commission, and dismisses with prejudice, its Request for a Certificate of Public Convenience and Necessity for said Parcel 1, insofar and only insofar as the following lands are described: Township North, Range East: Section : The East half; Section : The North half of SE 1/4; The South half of NE 1/4. (3) In view of the adjudication in the two preceding items, for administrative convenience, all the lands remaining in Parcel 1 as lands for which the       desires a Certificate of Public Convenience and Necessity which lie in Section , Township North, Range East, shall be denominated as Parcel l(a). and all of such said lands in Parcel 1 for which       continues to petition for a Certificate of Public Convenience and Necessity that are in Sections , , and of Township North, Range East, shall be denominated as Parcel l(b); (4) In further consideration of       withdrawing its said Objection to the above described portions of said Parcel 1,       recognizes that Section , Township North, Range East, all falls within one mile of the town limits of       , Mississippi, and       is not to begin to furnish water into such said section, formally or informally.
