DEFENDANT PRELIMINARY INJUNCTION AND TRANSFER AND CONSOLIDATION ORDER THERE CAME ON THIS DAY FOR HEARING the Complaint of the Plaintiff for a Preliminary Injunction, and the Court having carefully examined the verified Complaint and having heard the evidence and the argument of counsel, finds and orders: 1. The Plaintiff is an adult resident of County, Mississippi, and is doing business as . 2. Defendant is a resident of County, Mississippi, and was properly served with process, the Temporary Restraining Order, and Notice of Hearing. 3. This Court has jurisdiction over the parties and subject matter. 4. The Court issued a Temporary Restraining Order against the Defendant in this matter on , 20 . 5. The Court has balanced the hardship of granting or denying a Preliminary Injunction and finds that such balancing favors the Plaintiff, in that if injunctive relief were not issued in the form of a Preliminary Injunction to preserve the status quo pending a full hearing on the merits of the case, immediate and irreparable harm would result to the Plaintiff. If the injunctive relief applied for were not ordered, the Plaintiff would suffer immediate and irreparable injury, loss or damage. 6. The Court finds that the Plaintiff lacks any remedy at law, as to this issue. 7. The Plaintiff is entitled to a Preliminary Injunction commanding the Defendant to cease reproduction, publication and/or distribution of the document identified as "Exhibit A" to the Complaint or of any other information or document directed at the personal or professional defamation of the Plaintiff. 8. The Court further finds that a companion case to this matter styled vs. , Cause No. is presently pending in the Circuit Court of County, Mississippi, and that such case involves substantially the same facts as this matter. 9. The Court, on its own motion, further finds that since these two cases involve substantially the same facts, that it is in the interest of judicial economy, that this matter be transferred to the Circuit Court of       County, Mississippi and consolidated for further disposition with the case styled vs. , No. . IT IS THEREFORE, ORDERED, that the Defendant shall immediately cease any activity associated with the reproduction, publication and/or distribution of the document identified as "Exhibit A" to the Complaint, or of any other information or documents which are directed at the personal or professional defamation of the Plaintiff. IT IS FURTHER ORDERED, that this Preliminary Injunction shall be in force and effect until such time that this matter may be adjudicated on its merits.
