That at the time ______________ was appointed as Conservatrix of the person and property of ______________ on _______ ___ , 20 ___ , ______________ was the owner of an undivided interest in the real property located at ______________ , _______ , Mississippi, and more particularly described in the proposed Purchase Money Warranty Deed, a copy of which is attached to said Petition as Exhibit "A" and made a part thereof. 2. That ______________ inherited from her late husband, ______________ , the remaining undivided interest in said property. That the Estate of ______________ was administered in Cause No. _______ of this Honorable Court. 3. That Petitioner initially received an offer to purchase said real property from one ______________ , and this Court authorized the sale of said property to said ______________ by Order dated _______ ___ , 20 ___ . However, said ______________ failed to fulfill his offer to purchase said property and no longer desires to purchase same. 4. That Petitioner has received an offer to purchase said real property from ______________ and ______________ of _______ , Mississippi. That the said offer to purchase, as set out in Exhibit "B" attached to said Petition, reflects the true value of said property and is the best price for same available and that it would be in the best interest of the estate to sell said land and property to ______________ and ______________ of _______ , Mississippi, according to the terms as set out in Exhibit "B" and to give a Purchase money Warranty Deed for the said land and property. 5. That the proceeds from the sale of said land and property can be invested and yield a greater benefit to ______________ than can said land and property which is presently unoccupied and non-income producing. 6. That ______________ is an adult resident citizen of the City of _______ , _______ County, Mississippi, and is a sister of the said ______________ . That ______________ is an adult resident citizen of Mississippi, and is a grandson of the said ______________ . That ______________ and ______________ each joined in the prayer of said Petition, waived process, and entered their appearance at any hearing held on said Petition. 7. That Petitioner is an adult resident citizen of the City of _______ , _______ County, Mississippi, and is the daughter of the said ______________ ; that the parents of ______________ are deceased. IT IS, THEREFORE, ORDERED, ADJUDGED, AND DECREED: 1. That ______________ be and hereby is authorized as Conservatrix to sell the above described land and property to said ______________ and said ______________ under the terms set out in said Petition and in the exhibits attached thereto, and is hereby authorized to sign, execute and deliver a Purchase money Warranty Deed in the form as attached to said Petition as Exhibit "A". 2. That the posting of bond conditioned for the faithful application of the proceeds of this sale is hereby waived and that Petitioner is hereby authorized as Conservatrix to invest the net amount received from the sale in accordance with Section 91-13-3, Mississippi Code of 1972 , as amended. 3. That no confirmation of this sale before this Court shall be required and that the sale shall become effective immediately upon execution and delivery of the Purchase Money Warranty Deed.
