STATE OF MINNESOTA DISTRICT COURT COUNTY OF             JUDICIAL DISTRICT FAMILY COURT DIVISION In Re the Marriage of: Court File No.             , Petitioner, STIPULATION AND       , Respondent, Attorney's Name , and Client's Name do hereby stipulate and agree as follows: 1 Defendant acknowledges that [(s)he] is presently indebted to Plaintiff in the amount of $ _________ as of Date representing the unpaid balance and the reasonable value of the legal services, costs and disbursements and interest thereon provided by Attorney's Name to Client's Name . 2. Client's Name agrees to pay said indebtedness to Attorney's Name by making payments in the amount of $ _________ per month on or before the first day of each month, commencing Date , until the full amount of the indebtedness has been repaid. Interest shall accrue on the unpaid balance at the rate of       percent ( ___ %) per annum from Date . Client's Name may prepay additional sums beyond the minimum monthly payment described herein without penalty. Each payment shall be applied first to payment of accrued interest and the balance thereof in payment of principal indebtedness. 3. In the event of default in payment of any of the monthly payments required under - 1 - paragraph 2 herein, continuing for more than ten (10) days after notice of such default is sent to Client's Name by U.S. Mail at Client's Mailing Address . Attorney's Name may accelerate the payment of all unpaid installments and declare the entire unpaid amount immediately due and payable; and upon affidavit of Attorney's Name or its counsel, setting forth the existence of the default continuing for ten (10) days after notice, Attorney's Name may file the Confession of Judgment given pursuant to paragraph 2 of this Stipulation, and cause entry of judgment in _________ County District Court for the entire unpaid principal balance then due plus accrued interest. 4. Client's Name shall execute a Confession of Judgment in favor of Attorney's Name in the sum of $ _________ at the time of his/her execution of this Stipulation. Attorney's Name agrees to hold said Confession of Judgment, and not file it with the Court in absence of default by Client's Name not making the above-stated payments on the above-stated due dates. Said Confession of Judgment will state that it may be filed with the Court only upon Affidavit of Attorney's Name or its counsel that Client's Name is in default under this Stipulation. 5. In the absence of default, Attorney's Name agrees to refrain from filing this Stipulation and/or Confession of Judgment with the _________ County District Court and to refrain from collection efforts on any of the assets of Client's Name .
