IN THE CHANCERY COURT OF       COUNTY, MISSISSIPPI NO.             V.       MOTION FOR MODIFICATION 0F AUCTION SALE COMES NOW,       and       ("Purchaser") by and through their attorney, and respectfully requests this Honorable Court to order the sale of the martial home of       and       pursuant to the auction previously held with respect to such marital home subject to the following modifications: 1. That the Purchaser be given credit against the purchase price for interest paid on the earnest money deposit made by Purchaser from the date of the auction to the date of closing, calculated at eight percent interest per annum. 2. That if this Honorable Court confirms sale of the above-referenced property to Purchaser, then Purchaser shall be allowed ninety days from the date the order of confirmation is entered within which to close and consummate this purchase. 3. That the sale be consummated and the above-described property be delivered as advertised, and that, accordingly, the sellers not be permitted to retain and remove the "       " refrigerator. However, in the event that this Honorable Court permits the removal of the refrigerator, the purchase price shall be reduced by the amount necessary to repair any damage to the property caused by the removal.
