Nonexclusive License to Hunt and Fish on Property of Another Agreement made on the _____ day of ________________, 20____, between ________________________________ (Licensee) of __________________________ _________________________ (street address, city, county, state, zip code), referred to herein as Licensee, and __________________________ (Licensor), of _____________ __________________________________________________________ (street address, city, county, state, zip code), referred to herein as Licensor. I. Grant of Permission Licensor does hereby grant to Licensee the nonexclusive right, privilege, and permission the right to enter on the tract of real property described in Section II (hereinafter called Premises), and to hunt and fish on said Premises. Licensee's privilege to hunt and fish on the Premises shall extend from ______________ (date) to ________________ (date) unless otherwise revoked by Licensor as provided in this Agreement. Licensee may be accompanied by no more than _____ (number) other persons while exercising this license to hunt and fish. III.No Payment Required The permission granted in Section I is given to Licensee as an accommodation with no monetary consideration, and is revocable at any time by Licensor. IV. Licensor’s Right to Enter Premises Licensee's right to hunt and fish on the Premises shall be nonexclusive in the sense that Licensor may grant the same privilege to other licensees. Licensor reserves to Licensor, and to Licensor's successors and assigns, the right during the period of Licensee's license to enter the Premises for any purpose that Licensor may desire. Licensor agrees that Licensor will make such entry without unreasonable interference with the rights of Licensee. V. Licensee to Obey Laws A. Licensee agrees that Licensee and all guests of Licensee will fish on the Premises in accordance with the laws of ________________________________ (state).B. If Licensee or any guest of Licensee is held to have violated any such laws while on the Premises subject to this License, this License shall immediately terminate. VI.Release and Indemnification of Licensor Licensee does hereby release Licensor, her heirs, successors, and assigns _______ ________________________________________________________________________ ____________________________________________________ (collectively Releasees) from all liability of Releasees for any physical injury or death that results, directly or indirectly from the use Premises for hunting and/or fishing. Licensee further agree to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, or costs that Releasees (or any of them) may incur arising out of or related to the use of Premises by Licensee or a guest of Licensee for hunting and/or fishing, whether caused by the negligence of the Releasees or otherwise. VII.License not Assignable The license granted by this Agreement is personal to Licensee and is not assignable. VIII.Governing Law This Agreement shall be governed by, construed, and enforced in accordance with the laws of _______________________________________ (state). IX.Mandatory Arbitration Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
