IN THE CHANCERY COURT OF       COUNTY, MISSISSIPPI IN THE MATTER OF THE ESTATE OF       , DECEASED NO.       ORDER APPROVING CONTRACT OF THE SALE AND PURCHASE OF REAL ESTATE AND AUTHORITY TO SELL REAL PROPERTY THIS DAY came on this cause to be heard on the Petition of       , Individually and as Administrator/Administratrix of the Estate of       , Deceased, and       for approval of a Contract for the Sale and Purchase of Real Property owned by the decedent at the time of his/her death and the Court having read and considered said Petition filed herein, and being duly advised in the premises, finds as follows, to-wit: I. That       departed this life on       ,       . II. An Order was entered by this Court on             ,       , granting Letters of Administration to Petitioner,       . III. That       and       are the only heirs at law of the Deceased,       , and are the only persons with an interest in this estate. IV. One of the assets held by       , Deceased, at the time of his/her death was certain real property located in the County of       , State of Mississippi, more particularly described as the land and property located at       . V. That Notice to Creditors began publication as required by law on       ,       , and the statutory time to probate claims against the estate has not expired. That Petitioner,       , as Administrator/Administratrix , has made an investigation to identify persons having claims against the Estate of       , Deceased, and found none as evidenced by Administrator/Administratrix 's affidavit filed herein. VI. Petitioner,       , as Administrator/Administratrix of the Estate of       , has entered into a Contract for the Sale and Purchase of Real Estate with respect to the aforesaid asset, making said sale subject to the approval of this Honorable Court. A copy of said agreement being attached to the Petition filed herein. VII. That it would be in the best interest of the estate and to the heirs thereto to sell this real property. VIII. That the continued ownership of the aforesaid property constitutes a drain on the estate and that it would be in the best interest of the estate to sell this real property. IX. No appraisal has been made of this property, but Petitioners agree with and approve the value placed on said property and they believe that the terms of sale are acceptable, and further believe that an appraisal of said property should be waived. X. That Petitioners,       and       are the only persons with an interest in this estate, and they believe that any bond required herein should be waived. IT IS THEREFORE ORDERED AND ADJUDGED that Petitioner,       , as Administrator/Administratrix of the Estate of       , Deceased, shall have authority to complete and close the sale of the property located in the County of       , State of Mississippi, and more particularly described as       , upon the terms and conditions specified in the Contract for the Sale and Purchase of Real Estate, attached to the Petition as Exhibit "       ", said agreement being incorporated herein by reference and the necessity of any bond be posted herein by Administrator/Administratrix is hereby waived.
