Fill and Sign the Order Setting Cause for Hearing and Committing and Confining Defendant Without Notice to Mississippi Baptist Chemical Form

IN THE CHANCERY COURT OF       COUNTY, MISSISSIPPI       PLAINTIFF vs. CAUSE NO.             DEFENDANT ORDER SETTING CAUSE FOR HEARING AND COMMITTING AND CONFINING DEFENDANT WITHOUT NOTICE TO MISSISSIPPI BAPTIST CHEMICAL DEPENDENCY UNIT THIS DAY this cause came on to be heard on sworn Complaint for Judgment of Committal to Private Treatment Facility filed herein by       and       , Plaintiffs, against       , Defendant, and upon the allegations in said Complaint that the Defendant is under the influence of drugs to the extent that if the Defendant is served with process, he/she will, in all likelihood, flee the jurisdiction of the Court or physically harm himself/herself or others, and the prayer of the Complaint that the Court will set a hearing not more than five (5) days from the filing of the Complaint and order the Defendant committed and confined without notice until the hearing at       for treatment of drug addictions, and the Court having heard and considered said Complaint and the particular allegations thereof, finding by clear and convincing evidence that the Defendant, is under the influence of drugs to the extent that if he/she is served with process, he/she will, in all likelihood, flee the jurisdiction of the Court or physically harm himself/herself or others, further finds the following, to-wit: That this cause be and the same is hereby set for hearing on       day of       20       at       o'clock a.m./p.m. , in the Chancery Courtroom of the       County Courthouse at       , Mississippi, for hearing on the Complaint filed herein; That the Sheriff of       County, Mississippi, or such other Sheriff as can find the Defendant in his/her jurisdiction, should seize the Defendant and the Defendant should be committed and confined, without notice, until said hearing at       , being a chemical dependency and alcohol unit for the treatment of chemically dependent, alcoholic persons and the Defendant should be there so confined until the hearing hereof; and, That the Clerk of this Court be and he/she is hereby ordered to issue process for the Defendant returnable to the above hearing date, commanding him/her to appear and show cause, if any he/she can, why he/she should not be committed for such period of time as is necessary to provide for his/her care and treatment at       .
