GEOPHYSICAL AND SEISMIC OPERATIONS Form 1. This Lease does not and shall not be deemed grant Lessee the right to conduct geophysical exploration by means of seismograph, vibroseis or similar techniques on the lease premises. Lessee may conduct surveys in drilled well bores, such as electric logs, pressure t ests, gas analysis, or similar techniques. Form 2. The written consent of Lessor is required before Lessee may conduct any seismic or other geophysical operations on the lease premises within 1000 feet of any existing water well. Form 3. If geophysical exploration operations are conducted on this Lease, all shot holes shall be kept a sufficient distance away from Lessor’s water wells so as not to cause any dam age to the water wells. Lessee shall promptly plug all shot holes with concrete plugs set be low plow depth, fill the holes with dirt on top of the plugs, and restore the surface of the lease pre mises to substantially the same condition it was in prior to the commencement of the ge ophysical operations. Form 4. Any seismic work on the lease premises shall be limited to vibroseis methods. Lessee shall not conduct or authorize any person or persons to conduct seismographic operations on the lease premises which involve the drilling or coring on the land. Nothing in this Le ase shall prohibit geochemical examination of the lease premises. Form 5. Lessor also grants, leases, and lets to Lessee the nonexclusive right to conduct exploration, geologic and geophysical surveys by seismograph (including one mile beyond the boundaries of this Lease, as to any adjacent lands owned by Lessor and not under mineral lease to a third party at the date of this Lease and in the event the adjacent l ands are leased, Lessee will only be required to obtain the third party lessee’s permission prior to conducting the sei smic operations and the seismic exploration will be subject to the same conditions a nd obligations as those conducted on the leased premises, subject to the payment of damages to the surfa ce estate), core test and magnetic methods, the following described land in _____ County, _____. Form 6. If Lessee assigns, acquires, conducts, participates in or underwrites any geophysical surveys on any part of the leased premises or on lands pooled with the leased premises afte r the date of this Lease, then Lessee shall furnish free of cost to Lessor, within 30 days from t he date of this Lease, or within 30 days from Lessee’s own receipt of same, whichever is applicabl e, all seismic data and associated survey information, including but not limited to, a surveyed ownership map, topographic map, and G.P.S. position map showing the location of the shot points or vibration stations and well locations, and all other survey data, tapes, and copies of processed final stacked and migrated data volumes and sections pertaining to all ge ophysical surveys conducted on the leased premises plus one-half mile on each side of the boundary li nes of the leased premises if the line(s) continues that distance, and on lands pooled wit h the leased premises. Any of the above information furnished to Lessor by Lessee shall, if Lessee requests in writing, be considered confidential and shall not be disclosed to third parties, othe r than Lessor’s agents, for a period of two years after the end of the primary term of this Lease. In the event Lessee acquires the geophysical data under the terms of a license of other si milar agreement, Lessee shall obtain for Lessor’s benefit a license or extension of the lic ense rights to Lessor so that Lessor shall receive and have use of the seismic data licensed to Lessee to the same extent and subject to the same agreements as Lessee. In addition, Lessee grants Lessor and its agents and contractors unlimited viewing rights and access to review any geophysical data in Lessee’s possession provided that Lessor must come to Lessee’s office during normal business days and hours to review same.
