CAUSE NO.             DEFENDANT PETITION TO FIND DEFENDANT IN CONTEMPT COMES Plaintiff,       and files this his/her Petition to Find Defendant in Contempt for failure to abide by the Final Judgment of Divorce and subsequent Orders of this Court and would show in support the following: 1. Plaintiff is a resident of       County, Mississippi who resides at       . 2. Defendant       is an adult resident citizen of the       Judicial District of       County, Mississippi and may be served with process of this Court at       . 3. On       a Final Judgment of Divorce with Child Custody and Property Settlement Agreement incorporated therein was executed and filed by this Court. Said Property Settlement Agreement provided that Defendant would be responsible for paying and satisfying the joint debt of the parties at       Bank in the original amount of $       . The debt was secured by certificate of deposit owned by       , Plaintiff's mother. Defendant failed to pay the amounts due       Bank and a Petition for Contempt was filed and an Agreed Order entered on       finding Defendant in contempt for failure to pay said indebtedness. The Agreed Order provided that the Defendant would bring the indebtedness current and keep same current. 4. Defendant has willfully and intentionally failed to bring the indebtedness of       Bank current or to maintain its current status and that he/she is presently due for       and       ,       . Plaintiff would further state that       Bank will cash the certificate of deposit unless appropriate relief is awarded by this Court. 5. The Agreed Order also directed Defendant,       to pay unto Plaintiff child support of $       per month beginning       . Defendant has willfully failed to pay such support as directed by this Court and should be held in contempt for his failure. Defendant is in arrears in the amount of $       in child support payments and Plaintiff should be awarded Judgment for said amount. 6. Defendant was held in contempt in the Agreed Order for his/her failure to pay child support and interest on a note to       Bank in the amount of $       and $       respectively. Defendant has willfully failed to pay Plaintiff these amounts and should be held in contempt and Plaintiff awarded an Order of Contempt and Judgment. 7. A Withholding Order should be entered directing that Defendant's employer withhold appropriate amounts for child support or other security should be provided for the payment of the sums due Plaintiff and       Bank. 8. Defendant should be held in contempt for his/her failure to pay medical bills or provide Plaintiff proof that same have been paid. The Plaintiff is without sufficient funds with which to pay his/her attorney and ask this Court to award him/her a reasonable attorney's fee. WHEREFORE, PREMISES CONSIDERED, Plaintiff prays that the Defendant be summonsed and that after a hearing that the Defendant be found in willful contempt of this Court for failure to pay child support in the amount of $       and back child support in and interest in the amount of $       and that the Court order Defendant to bring the indebtedness to       Bank current immediately and that he/she be confined to the custody of the Sheriff of       County, Mississippi his/her failing to bring said note current or pay the amounts due within a reasonable amount of time.
