Petitioners, being the children, sole heirs at law of       and beneficiaries under the Will of       , recognizing that the real estate and       in question cannot be divided in kind, desire to sell said items to a buyer for an amount equal to or greater than the fair market value of each. 4. Petitioners would show unto the Court that the real estate was appraised on             ,       , by       , a licensed and qualified appraiser, and that the fair market value of the real estate was determined to be approximately $       . Petitioners would further show that the Executor(Trix) has been approached by certain buyers who have offered to purchase the real estate in its "as is" condition for $       .
