Page 1 of 2 EASEMENT AND RIGHT OF WAY (For Electrical Transmission Lines – Short Form) STATE: COUNTY: _____ (the “Grantor”), whether one or more, whose address is _____, for valuable consideration, the receipt and sufficiency of which is acknowledged, GRANTS, SELLS, and CONVEYS to _____ (the “Grantee”), its successors and assigns, whose address is _____, an easement and right of way for electric transmission lines consisting of poles or towers made of wood, metal, or other materials, wires, circuits, underground cables, static wires, communic ation circuits, cross arms, insulators, guys, and all necessary or desirable appurtenances, over, across, on, or under the property described in the attached Exhibits (referred to as the “Easement”). SEE EXHIBIT “A” AND “B” ATTACHED TOAND MADE PART OF THIS EASEMENT Together with the right of ingress and egress, over, across, and on the land and Grantor’s adjacent land, for the purpose of construction, operation, reconstruction on poles or metal towers, enlarging, inspecting, patrolling, repairing, maintaining, and removing lines, circuits, pole s, metal towers, wires, underground cables and appurtenances; the right to relocate along the same general direction of lines; and the right to remove from lands all trees and parts of them, or other structures or obstructions, which endanger or may interfere with the safety or efficiency of the lines or appurtenances. GRANTOR AND GRANTOR’S SUCCESSORS, ASSIGNS, AGENTS, LICENSEES, AND LEGAL REPRESENTATIVES SHALL NOT CONSTRUCT OR PERMIT TO BE CONSTRUCTED ANY HOUSE, STRUCTURE, RESERVOIR, OR OTHER OBSTRUCTION OR EXCAVATION, ON, OVER, OR WITHIN THE EASEMENT AREA, AND SHALL NOT CHANGE THE GRADE WITHIN THE EASEMENT AREA, WITHOUT THE EXPRESS WRITTEN CONSENT OF GRANTEE. In addition to the consideration provide above, Grantee shall pay Grantor for all damage to Grantor’s growing crops, furrows, roads and fences done in connection with constructing, inspecting, maintaining, repairing, reconstructing, and removing the lines on the land. TO HAVE AND TO HOLD the described Easement and rights to the Grantee, its successors and assigns, until all of the lines shall be abandoned and removed. Grantor binds himself, his heirs, assigns, and legal representatives to warrant and forever defend all and singular the described Easement and rights to the Grantee, its successors and assigns, against every person lawfully claiming or to claim the same or any part of it.
