Release and Waiver of Liability Given in Favor of Nonprofit Organization Regarding Allowing Minor to Ride Horses on Ranch Operated by Organization (including Assumption of all Risks of Bodily Injury) Agreement made on the _____ day of __________________________, 20_____, between __________________________________________ (Name of Rider) of _________________________ _____________________________________________________________________________________ __________________________ (street address, city, county, state, zip code), referred to herein as Rider, and ___________________________________________________ (Name of Non-Profit Organization) located at ____________________________________________________________________________ _______________________________________________ (street address, city, county, state, zip code), referred to herein as Organization; Whereas, Organization is a not for profit organization which operates a ranch which houses and cares for horses and other animals with special needs (including horses that are blind, partially blind and advanced in years); and Whereas, Organization allows the public to ride these horses under controlled circumstances such as a volunteer or employee of the Organization leading the horse; and Whereas, the undersigned Rider desires to ride one or more of said horses; and Whereas, since Rider is a minor, the undersigned parent or guardian is signing this instrument for and on behalf of Rider; Now, therefore, for and in consideration of riding one or more of said horses, the undersigned Rider hereby releases Organization, its employees, officers, directors, successors, and assigns (collectively Releasees) from all liability to Rider for any loss or damage to property, physical injury or death whether caused by Releasees or otherwise that result, directly or indirectly from Rider’s riding said horse or horses. Rider further agrees to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, or costs that they (or any of them) may incur arising out of or related to Rider’s riding said horse or horses whether caused by the negligence of the Releasees or otherwise, and Rider does hereby assume the risk of any such loss or damage. Any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and bot h arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute . The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. The undersigned parent or guardian of Rider, in consideration of allowing my child or ward to ride said horse or horses, hereby agrees individually and on behalf of my child or ward, to the terms of this Release, Waiver of Liability and Assumption of Risk.
