Whereas, Purchaser has agreed with Facilitator to accept this Horse “as is” and “as delivered”
and is hereby waiving and releasing Facilitator for any damage to Horse during the sale and/or
shipping process;
Now, therefore, Purchaser hereby agrees as follows:
Purchaser acknowledges and agrees that the Horse is being sold, transferred, delivered and
conveyed without any representations or warranties of Facilitator of any kind, express or
implied, including, but not limited to, warranties of merchantability or fitness for a particular
purpose. Accordingly, Purchaser fully and forever releases, waives and discharges Facilitator
from any and all claims, suits, damages, losses, and other liabilities, in any way arising out of or
in connection with Purchaser’s purchase, ownership, possession or use of the Horse and/or the
delivery of the Horse.
Purchaser has read and voluntary signs this release and waiver of liability and claims, and
understands that he/she intends that his/her signature is a complete and unconditional release of
all liability of Facilitator to the greatest extent allowed by law.
The invalidity of any portion of this agreement will not and shall not be deemed to affect the
validity of any other provision. If any provision of this agreement is held to be invalid, the
parties agree that the remaining provisions shall be deemed to be in full force and effect as if
they had been executed by both parties subsequent to the expungement of the invalid provision.
This agreement shall be governed by, construed, and enforced in accordance with the laws of the

party or an authorized representative of each party.
The rights of each party under this agreement are personal to that party and may not be assigned
or transferred to any other person, firm, corporation, or other entity without the prior, express,
and written consent of the other party.
This agreement may be executed in any number of counterparts, each of which shall be deemed
to be an original, but all of which together shall constitute but one and the same instrument.
