Fill and Sign the Resolution Authorizing Filing of Eminent Domain Action Mississippi Form

RESOLUTION AUTHORIZING FILING OF EMINENT DOMAIN ACTION AGAINST ____________________________ WHEREAS, the City of _______________________, Mississippi is in the process of preparing to construct a roadway within the City; and WHEREAS, fee simple title and an utility easement to certain property is required to construct said roadway across property of certain property owners within the City; and WHEREAS, ________________________ owns certain property within the right - of - way of said roadway said property being more particularly described as follows: SEE ATTACHED EXHIBIT "A" WHEREAS, the City has been unable to negotiate a purchase of said property; and WHEREAS, it is necessary that the fee simple title and an utility easement be taken by eminent domain pursuant to Miss Code Ann. Section 11 - 27 - 1 et. seq. (1972); and WHEREAS, the City has the power to use the "Quick Take" procedures of the Mississippi Code and the filing of an eminent domain action by the "Quick Take" procedures authorized by Miss. Code Ann Section 11 - 27 - 81 et. seq. should be authorized. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Aldermen of the City of ______________________, Mississippi as follows: That ______________________, are hereby authorized to institute on behalf of the City of ______________________ an Eminent Domain action pursuant to Miss.
