Fill and Sign the Resolution Directing Hearing on Proposed Approval of Combination Redevelopment Plan and Tax Increment Financing Plan Mississippi Form

The Board of Aldermen took up for discussion taking further action toward the issuance of tax increment bonds for the benefit of       and Alderman       moved the adoption of the following resolution: RESOLUTION OF THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF FLOWOOD, MISSISSIPPI, DIRECTING THAT A PUBLIC HEARING BE HELD ON THE PROPOSED APPROVAL OF A COMBINATION REDEVELOPMENT PLAN AND TAX INCREMENT FINANCING PLAN WHEREAS, the Mayor and Board of Aldermen (the"Governing Authority") of the City of Flowood, Mississippi (the "City"), are empowered by Mississippi Code of 1972, as amended, Section 21 - 45 - l through 21 - 45 - 21 (the "Act"), to enter into tax increment financing arrangements; and WHEREAS, on September 7, 1993, the Governing Authority enacted a resolution setting forth its intention to provide tax increment financing for the benefit of       , a Mississippi limited partnership (the "Developer"), for a retail and commercial development consisting of a shopping center, motel and related outparcels (the "Redevelopment project") to be located on a site of approximately nine acres at the             (the "Site"); and WHEREAS, the Act requires that preliminary to the issuance of any tax increment bonds a redevelopment plan must be approved in the same manner and at the same time provided in Mississippi Code of 1972, as amended, Section 43 - 35 - 13, for approval of urban renewal plans; and WHEREAS, the Act provides that a redevelopment plan may contain a tax increment financing plan; and WHEREAS, the Act provides that before the Governing Authority can approve a tax increment financing plan, it must hold a public hearing thereon after published notice in a newspaper in which the municipality is authorized to publish legal notices at least once and not less than ten days nor more than twenty days prior to the hearing; and WHEREAS, the Governing Authority has caused to be prepared a proposed redevelopment plan which contains a tax increment financing plan and includes a proposed interlocal agreement with Rankin County (collectively the "Plan"); and WHEREAS, the Governing Authority has determined that it should institute the public hearing procedures in order to allow the City to approve the Plan; and WHEREAS, the Plan is attached as Appendix 1 to this resolution and is made a part hereof; NOW THEREFORE BE IT RESOLVED AS FOLLOWS: Section 1. The statements of law and fact set forth in the above and foregoing preamble are hereby declared and adjudicated to be true and correct. Section 2. On             , 20       , the Governing Authority shall in accord with the Act hold a public hearing on the proposed approval of the Plan, such hearing to be held at       o'clock __.M. in the Governing Authority's usual meeting place in the City Hall in Flowood, Mississippi. Section 3. In order to give proper notice of said public hearing, this resolution, together with its Appendix, shall be published one time at least ten days but no more than twenty days prior to the aforesaid hearing date in the Rankin County News, a legal newspaper published in the City of Brandon, Rankin County, Mississippi, having a general circulation in the City of Flowood and the area within five miles of the City of Flowood and being in all ways qualified for publication of the City's legal notices. Section 4. The Plan is hereby ordered to be submitted to the City's Planning Commission which is hereby requested to review the Plan, make its recommendations as to the Plan's conformity with the general plan for the development of the City as a whole, and submit its written recommendations to the Governing Authority prior to the time set for the aforesaid public hearing. Section 5. It is hereby directed that a copy of this resolution and the Plan be transmitted to the Board of Supervisors of Rankin County, and the Governing Authority does hereby request the Board of Supervisors of Rankin County to enact a resolution approving the Plan and authorizing the President and Clerk of the Board of Supervisors to execute the Plan. Section 6. The City Attorney is hereby authorized and directed to transmit the Plan to the Attorney General of the State of Mississippi pursuant to Mississippi Code of 1972, as amended, Section 17 - 13 - 11 for approval as an interlocal agreement. Section 7. For cause, this resolution shall be of full force and effect from the date hereof. Alderman       seconded the motion.
