NON-EXCLUSIVE ROADWAY RIGHT OF WAY STATE: COUNTY: The undersigned, _____ (the “Grantor,” whether one or more), the owners of the real estate described below, for valuable consideration, the receipt of which is acknowledged, grants, conveys, and warrants to _____, its successors and assignees (the “Grantee”), the non-exclusive right, right of way, and easement in, over and across the following land in _____ County, _____: (Land Description) Grantee is granted the full right to occupy and utilize a portion of that land for roadwa y purposes, for use by Grantee, its employees, agents and licensees and their equipment, wit h the right to surface any road. The right of way granted shall be _____ feet in width, as described by metes and bounds as follows: (Right of Way Description) TO HAVE AND TO HOLD the right of way and easement until a roadway is constructed on it and so long thereafter as a roadway is maintained on it, to be used non-exclusively. In consideration of this grant the parties agree: (a) Grantor, _____ heirs and assigns, shall, without obligation of maintenance, have the right to use the roadway for any and all passage purposes; provided Grantee shall not be liable for any injury or damage to Grantor or third persons resulting from that use. (b) Grantee shall install gates, cattle guards or culverts, at any point or points where the roadway may cross existing fences on the real estate and, in the event gates are i nstalled, a key will be furnished Grantor and his tenant, if any. Gates or cattle guards installed shall be considered the personal property of Grantee, but on the termination of this grant will be left on the property. (c) Grantor and Grantee agree that the person securing this grant is without authority from Grantee to make any agreement in respect to the subject matter of it not expressed in this grant.
