For and in consideration of the mutual covenants contained in this Agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Performance of WorkA. B. One set of plans and specifications will be furnished to Subcontractor without cost. Additional sets may be procured at rates established by Owner, to be available at Contractor's office at the address set forth above. 4.
Subcontractor is responsible for the execution of the original contract, for making copies and copies of specifications, plans and addenda, and the other materials furnished under, and under, this agreement, and for the return of all the same by owner to contractor as is required by this paragraph (b) within 60 days of the date of the original contract between contractor and subcontractor and as may be otherwise ordered by us. 1. After such 60-day period, subcontractor will furnish to owner a copy of both sets of plans and specifications furnished under paragraph (b) of this section within 10 days after such 60-day period. 2. When materials are furnished to the contractor, subcontractor will make copies and copies of both sets of plans and specifications of labor and materials furnished under paragraph (b) of this section, and of all addenda, and the specification. 3. If labor and materials furnished under paragraph (b) of this section and under this agreement are not properly returned by the owner to contractor within the period specified in paragraph (b) of this section, or at a rate established by us as being sufficient for our proper disposition of the same after the period specified, owner may charge a fee on any unexpended portion of such materials which we may determine the owner has improperly retained. 4. Contractor waives any lien by reason of any defect arising from work under this agreement, including work performed by subcontractor, upon any property used by contractor or subcontractor in carrying out this contract; provided, however, that, if for any reason it is not possible or economical for subcontractor to correct such defect, the contractor will be responsible for paying its costs thereof. (c) (1) if any provision of this agreement or the obligation of each party to fulfill the terms hereof shall be held to be invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remainder of this agreement and/or of the contract shall not in any way be affected thereby. (2) if any provision of this agreement or the obligation of each party to fulfill the terms hereof shall be held to be invalid, illegal, or unenforceable in any particular case, no other or additional provision hereof shall be deemed to modify, amend, limit, or otherwise affect in any way such invalidity, illegality, unenforceability, or unenforceable provision or result therefrom.
