DESCRIPTIONS OF FORMS Brief descriptions of the forms contained in your U.S. Legal Forms™ Landlord Tenant Eviction / Unlawful Detainer Forms Package are found below. 5 Day Notice to Pay Rent or Lease Terminates – Residential - This form is used by a landlord to demand payment of overdue rent from a residential tenant within 5 days from giving the notice, in accordance with the laws of your state. (Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Residential" includes a house, apartment or condo. If the tenant fails to pay within 5 days, the lease may be considered terminated by the landlord. The tenant is informed that the tenant must either pay the rent or suffer possible termination. If he does not pay, the landlord may begin eviction proceedings. If the landlord does not elect to proceed with termination or eviction, but instead agrees to accept rent after the termination date stated in the notice, the lease is generally reinstated. 14 Day Notice of Material Noncompliance with Rental Agreement for Residential from Landlord to Tenant - This form is used by the landlord to notify a residential tenant of a breach of the lease due to material non-compliance with the lease provisions. "Residential" includes a house, apartment, or condo. The specific material non-compliance is identified, and the tenant is given 14 days to cure the breach or suffer termination. 20 Day Notice to Terminate Tenant of Will for Nonresidential from Landlord to Tenant - This form is used by a landlord to terminate an at-will residential lease by giving 20 days notice to the tenant. "Residential" includes a house, apartment or condo. An "at-will" lease is one which may be terminated at any time, for any reason- or for no reason at all- by either the landlord or the tenant. Rent is typically payable on a monthly or yearly basis. 30 Day Notice to Terminate Month to Month Lease for Nonresidential from Landlord to Tenant - This form is for use by a landlord to terminate a month-to-month non-residential lease. "Non-Residential" includes commercial, industrial, etc. property. Unless a written agreement provides otherwise, the landlord does not have to have a reason for terminating the lease in this manner, other than a desire to end the lease. A month-to-month lease is one which continues from month-to-month unless either party chooses to terminate. The notice must be given to the tenant within at least 30 days prior to the termination date. The form indicates that the landlord has chosen to terminate the lease, and states the deadline date by which the tenant must vacate the premises. Application for Ejectment /Eviction - This form is filed by a landlord to seek an order of eviction against an unwanted tenant. Affidavit for Eviction - This is filed by the landlord with the application for ejectment to explain the reason why eviction of a tenant is being sought. This form must be signed in front of a notary and notarized. Rule to Vacate or Show Cause (Eviction) - This form is signed by the court to order a tenant to leave the premises or face removal by the sheriff Writ of Ejectment / Eviction - This form is signed by the court to order a sheriff to remove the tenant from the premises after a landlord wins an eviction case.
