STATE OF MINNESOTA DISTRICT COURT COUNTY OF __________ __________ JUDICIAL DISTRICT FAMILY COURT DIVISION In Re the Marriage of: Court File No. __________ __________ , Petitioner, STIPULATION AND ORDER AND __________ , Respondent, WHEREAS, the parties are principles in an action for dissolution of their marriage which was commenced by service of a Summons and Petition on __________, 20___ ; and WHEREAS, an issue concerning the legal and physical custody of the parties' minor children has arisen during the pendency of the dissolution proceedings, and WHEREAS, the parties are unable to resolve the issue of legal and physical custody of their minor children through mutual agreement or mediation; and WHEREAS, the parties have reached a stipulated agreement concerning a custody evaluation; NOW, THEREFORE, based on the stipulation and agreement of the parties as set out below and upon all of the files, records, and proceedings herein, the Court makes the following: ORDER 1. The matter of the custody of the parties' minor children shall be immediately referred to __________ County Court Services for study and evaluation. 2. Both parties are directed to cooperate fully in the custody evaluation and make the - 1 - minor children available to participate in the evaluation as requested by __________ County Court Services personnel. 3. Upon completion of the custody evaluation, __________ County Court Services personnel shall prepare a written report containing recommendations regarding the physical and legal custody of the minor children. 4. The report of __________ County Court Services including recommendations regarding legal and physical custody of the minor children shall be submitted to the Court and copies shall be sent to attorneys for each of the parties.
