The owner will make a reasonable effort to contact the individual subcontractor and ensure delivery and delivery of material. If the owner and contractor are unable to meet the subcontractor's delivery deadlines or have reason to believe the subcontractor is not in fact working on the project or is working on a different work in a different location, (name of subcontractor or owner) will immediately notify them. If work is subcontracted to a subcontractor who does not meet the deadlines set forth in paragraph 1 of this agreement, the owner will promptly notify the contractor in writing that work has been performed, but subcontractor has failed to deliver work to completion as designated by the contractor. This notice shall be sent to the address of contractor and should be given no later than one week prior to the date that the owner expects that work will be performed. If the contractor or subcontractor does not have reasonable basis for such failure to fulfill its contractual obligations to the company as set forth below, the owner will take steps to seek damages or other action as may be necessary to rectify the situation. 5.
