(LAW FIRM) ATTORNEYS AT LAW Supplemental Custody Retainer This Agreement is by and between (LAW FIRM) , Attorneys at Law and ___________________ (herein after called Client) and is intended to supplement the Fee Retainer Agreement. The Client agrees to pay the sum of ___________________ ($ ___________ ) as and for a Supplemental Custody Retainer. Said sum shall be due and payable no later than one week prior to the first scheduled pre-trial date or within one week of the attorneys receipt of notice that a trial date is set by the court, whichever occurs first. It is the Client's responsibility to budget for this supplemental retainer or make other arrangements for it to be paid when due and this agreement should suffice to warn the Client to prepare for the possibility that this Supplemental Custody Retainer may be required. The Client understands and acknowledges that if the Supplemental Custody Retainer fee is not paid as required (LAW FIRM) may immediately withdraw from continued representation of the Client on the custody and all other matters for which representation was provided as set forth in the Fee Retainer Agreement. Said Supplemental Custody Retainer shall be used to cover only attorney and paralegal fees. It shall not be applied to any costs for experts or documents needed to prepare and/or proceed to trial. The Supplemental Custody Retainer will be applied to the fees incurred in preparing the case for a custody trial or conducting a trial, regardless of whether the custody issue is settled or litigated before a judge. At the conclusion of the case, any unused portion of the Supplemental Custody Retainer shall be applied to the unpaid portion of attorney and paralegal fees, and then applied to any and all outstanding unpaid costs and disbursements. All sums remaining shall be refunded to the Client. The Client is advised that custody cases which are seriously contested can result in fees that easily exceed $ ___________ . Fees can possibly exceed $ ___________ depending on complexity of the case. The Client understands that in agreeing to pay the Supplemental Custody Retainer, the Client is not being promised that fees, costs and disbursements will be $ ___________ or less. The Client also acknowledges that he/she is bound not only by the terms of this Supplemental Custody Retainer Agreement, but by the Fee Retainer Agreement which this agreement supplements. The supplemental retainer is in no way intended to obviate, alter or cancel the Clients obligation to pay ongoing fees on a monthly basis. Rather this Supplemental Custody Retainer is intended to guarantee trial/contested final hearing fees which accrue.
