FORCE MAJEURE Form 1. In the event Lessee claims the benefits and rights granted under the force majeure clause contained in the printed portion of this Lease, as a condition of Lessee’s utilizing t he rights granted under the force majeure clause, Lessee shall provide Lessor written notice of the claim, outlining the reasonably full particulars of the basis of the force majeure claim. The benefits and rights of the force majeure clause shall be available only when the cause clai med is the proximate cause of a delay or failure to perform, and only so long as Lessee is using its best efforts, exercised in good faith, to remedy or eliminate the force majeure. Form 2. Notwithstanding the provisions of the force majeure clause contained in this Lease, tha t provision shall not apply to any delay or discontinuation of operations resulting from a shortage in supplies or equipment for periods of time in excess of (Specify Time Period). Form 3. If Lessee is prevented from complying with any express or implied covenants of this Lease, from conducting drilling or reworking operations on the lease premises, or from producing oil or gas by reason of force majeure, or as a result of any law, order, rule or regulation of federal, state or municipal governmental authority or any other governmental authority having jurisdiction, upon Lessee giving Lessor written notice with reasonable particulars of the cause of the prevention, within ____ days after the occurrence of the ca use, the time for spudding a well, or actual drilling of a well shall be suspended for a period of not more than ____ consecutive days. This provision applies only to that portion of the lease premises affected by the force majeure clause and shall not perpetuate this Lease more than ____ days, either successively or cumulatively, beyond the primary term.
