(Note: If a written agreement provides for a longer notice, use the notice length stated in the agreement). "Residential" includes a house, apartment or condo. If the tenant fails to pay within 14 days, the lease may be considered terminated by the landlord. The tenant is informed that the tenant must either pay the rent or suffer possible termination. If he does not pay the landlord may begin eviction proceedings. If the landlord does not elect to proceed with termination or eviction but instead agrees to accept rent after the termination date stated in the notice, the lease is generally reinstated. 15 Day Notice to Terminate Month to Month Lease Including Shared Space in Landlord's Personal Residence – Residential - This form is used by a landlord to terminate a month-to- month lease when a tenant rents a room in the landlord's personal residence, and the tenant is allowed use of some common areas with landlord such as a kitchen, living room, etc. A month- to-month lease is one which continues from month to month until landlord or tenant decide to terminate the lease. The landlord need not have any reason to terminate the lease other than a desire to do so. The tenant must vacate the premises within 15 days of receipt of the notice. 30 Day Notice to Terminate Lease for Material Breach – Residential - This form is used by a landlord to terminate a residential lease (of any length) due to the tenant's material breach of the lease agreement (other than non-payment of rent- for non-payment of rent see form VT- 1265LT). The specific breach is identified by landlord in a blank area in the form, and landlord is not required by law to allow the tenant to attempt to cure (repair) the breach. The landlord may elect to allow the tenant a chance to cure by checking the appropriate check-box on the form. Material breach is a contract law term which refers to a failure of performance under the contract which is significant enough to give the aggrieved party the right to sue for breach of contract. When there has been a material breach, the aggrieved party is also relieved of a duty of further performance under the contract. However, a minor divergence from the terms of the contract is not a material breach. A material breach is one that is significant enough to destroy the value of the contract. 30 Day Notice to Terminate Verbal Lease When Leased Premises is Sold – Residential - This form is used by a landlord to terminate a verbal lease (of any length) when landlord opts to sell the building. Notice must be given at least 30 days prior to the date of termination. 30 Day Notice to Terminate Written Month to Month Lease Where Tenant Has Resided in Premises Two Years or Less - Residential - This form is used by a landlord to terminate a written month-to-month lease when the tenant has resided in the premises for two years or less. The landlord need not have any reason to terminate the lease other than a desire to do so. 60 Day Notice to Terminate Verbal Month-to-Month Lease Where Tenant Has Resided in Premises Two Years or Less – Residential - This form is used by a landlord to terminate a verbal month-to-month lease when the tenant has resided in the premises for two years or less.
