RIGHT OF WAY (For Electrical Lines) STATE: COUNTY: _____, whose address is _____ (the “Grantor”, whether one or more), for valuable consideration, the receipt of which is acknowledged, grants, conveys, warrants, and delivers to _____, its successors and assigns, whose address is _____ (the “Grantee”), the right, privilege, easement, and servitude, forever, to construct, operate and maintain one or more electric al lines, each consisting of a single or multiple line of poles and/or towers, with the wires, cabl es and other appurtenances as may be necessary or convenient for the purpose of transmitting elect ric energy and/or communications, together with a perpetual right of way _____ feet (_____’) in width, with the centerline of the right of way being _____, and the right to open, clear, and maintain the right of way and to keep it clear of underbrush, trees, other growths, and any obstruction which, in the sole judgment of the Grantee, might interfere with or constitute a hazard to the operation of the electric lines, and with the free right of ingress a nd egress to and from and on the right of way for the purpose of constructing, maintaining, repairing, replacing, operating, adding to, relocating, rebuilding, or removing at will the electric lines or any portions of them and appurtenances, and with the right to replace poles with towers, and towers and pol es, on, over, under and across the following lands in _____ County, _____: (Description of Land) The Grantee shall also have the right and privilege, forever, to patrol, alter, inspect , improve, relocate, rebuild, repair, and remove poles, towers, lines, wires, cables, attac hments, equipment and appurtenances, including the right to increase or decrease the number of wire s, poles or structures, and all other rights and privileges necessary or convenient for the full use and enjoyment of the right of way granted for the purposes described, including the right of ingress and egress to and from the right of way over adjoining lands of the Grantor. To have and to hold the right of way, servitude, and privileges to the Grantee, its successors and assigns, forever, subject to the conditions and limitations contained in this Grant. It is stipulated that said right of way will never be fenced by Grantor, and Grantor shall have full use of the right of way except for the purposes for which the same is conveyed to Grantee, and except for uses which interfere with the enjoyment by Grantee of the rights and servitude conveyed to it, and provided always that no building or structure of any nature or kind whatsoever, nor any part of one, shall be constructed, installed, placed or permitted on or over the right of way or any part of it, except for the structures of Grantee. Grantee agrees to pay any damages, which may be inflicted by it in the construct ion and maintenance of the lines, provided an itemized claim of them shall be presente d by the Grantor in writing to the office of the Grantee, within thirty (30) days after the damage is done. If not mutually agreed on, the damages are to be ascertained and determined by three disinterested persons, one of whom shall be appointed by the Grantor, one by the Grantee, and the third by the two so appointed, and the award of those three persons shall be final and conclusive.Grantee shall have the right to remove trees adjacent to right of way which are or may become tall enough to constitute a hazard to the use of the electric lines and shall pay Grantor the value of the trees, as timber, when removed. So long as it maintains an electric line on the described right of way, the Grante e, its successors and assigns, is granted the option or right to purchase an additional right of way _____ feet (_____’) in width adjoining and parallel to the described right of way, for the construction, operation, and maintenance of additional electric lines subject to the same terms and conditions stipulated in this Grant, and shall pay to the then owner of the land for the additional right of way the same price per acre as is paid for this right of way.
