Waiver and Release from Liability for Using Indoor Softball and Baseball Batting Cage (Use by Minor) Whereas, _____________________________________ (Name of Owner of Batting Cage) , herein sometimes referred to as Owner , owns and operates an indoor softball and baseball batting cage (the Cage ) at ______________________________________________ ___________________________________________________________________________ (street address, city, county, state, zip code) ; and Whereas, the undersigned is the Parent or legal Guardian of ____________________ __________________ (Name of Participant) , hereinafter sometimes called Participant , who is under the age of (i.e., age of majority such as 18) ______, and desires to use the Cage on ________________________________ (date) ; and Whereas, Owner requires that this Waiver and Release be executed as a condition of using the Cage ; Now, therefore, for and in consideration of using the Cage, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned, individually and for and on behalf of Participant, agrees to the following: Participant does hereby waive and release, indemnify, hold harmless and forever discharge Owner and his agents, employees, officers, directors, affiliates, successors and assigns (hereinafter called Releasees ), of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that Participant ever had or may have, arising from or in any way related to use of the Cage, today, or on any future date. Participant understands that the activities that he/she will participate in can be dangerous and may cause serious or grievous injuries, including bodily injury and/or death. However, Participant waives all claims for damages, injuries and death sustained by Participant that he/she may have or hereafter acquire against Releasees as a result of using the Cage. By execution of this Waiver and Release, Participate assumes any risk, and take full responsibility and waive any claims of personal injury or death associated with using the Cage. This Waiver and Release contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this Waiver and Release. The provisions of this may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties. The undersigned Parent or Guardian of Participant agrees to indemnify the Releasees and hold them harmless from any loss, liability, damage or cost they may incur (whether caused by the negligence of the Releasees or otherwise) due to the use by Participant of the Cage. The undersign Parent or Guardian of Participant acknowledges that he/she has read, understands and fully agrees to the terms of this Waiver and Release individually and on behalf of Participant , and understands and confirms that by signing this Waiver and Release, he/she has possibly given up considerable future legal rights. The undersign Parent or Guardian of Participant has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to the undersigned Parent or Guardian.
