IN THE CHANCERY COURT OF COUNTY, MISSISSIPPI IN THE MATTER OF THE DISSOLUTION OF THE MARRIAGE OF: CIVIL ACTION NO. , and JOINT COMPLAINT FOR DIVORCE - IRRECONCILABLE DIFFERENCESCOME NOW, (“ ”) and (" ") relationship, file this their Joint Complaint for Divorce, pursuant to the provisions of MCA Section 93-5-2 (1972 as amended), and for grounds in support thereof, would show unto this Court the following: I. That is an adult resident citizen of County, Mississippi; and, is an adult resident citizen of County, Mississippi, and, they have each been residents of County, State of Mississippi for more than next preceding the filing of this Joint Complaint for Divorce. II. That and are members of the or race; that and were lawfully heretofore married to each other on , , in County, ; that of said marriage, children were born, namely NAME DATE OF BIRTH and, that is not now pregnant. III. That the present address of the minor children of the parties is , , County, Mississippi and has been such since the minor children were born; that the said minor children have not lived with or been in the care of any persons other than the parties to this action since their birth and next preceding the filing of this Joint Complaint for Divorce; that these parties have not participated as a party or a witness in any other capacity in any other litigation concerning the custody of said minor children in this state or any other state; that these parties have no knowledge of any other custody proceeding involving said minor children in this state or any other state; and, that these parties know of no person not a party to this action that has physical custody or claims to have physical custody or visitation rights with said minor children. IV. That the parties lived together as husband/wife, from the date of their marriage until , , at which time they finally separated, while living in County, Mississippi; that the marriage of the parties is irretrievably broken, and there are no reasonable prospects for reconciliation, and according to MCA (Supp. 1992) Section 93-5-2, the parties seek and are entitled to a divorce, each from the other, upon the ground of IRRECONCILABLE DIFFERENCES. V. That the parties will enter into a Marital Dissolution Agreement, which will ma ke adequate and sufficient provisions for the custody and maintenance of their minor children, and for the settlement of all property rights between them, which agreement will be attached to the Final Judgment in this cause as Exhibit " ". VI. That in the event that a Judgment of Divorce is granted to these parties, they wi ll keep each other informed of their respective addresses, including state, city, street, house number and telephone number (if available); that the parties shall within five days of either changing their address, so long as their child is a minor, notify the Clerk of this Court of his/her new address in writing, including therein the file number of this action, and he/she shall furnish the other party a copy of such notice. VII. WHEREFORE, and pray that this Joint Complaint for Divorce be received and filed and after a period of sixty days following said filing, the Court will hear this Joint Complaint for Divorce, as provided by law; and, the Court will award unto the parties upon said hearing the following relief: a. A full, absolute, final and complete divorce of and from each other upon the ground of IRRECONCILABLE DIFFERENCES. b. That the Court will incorporate into its Judgment of Divorce the provisions, terms and conditions of the Marital Dissolution Agreement of the parties, requiring them to perform e ach and every term and condition thereof, they being subject to the contempt powers of this Court for their failure to do so. c.
