collector to dispute a debt my name is michael wassick i'm one of the lawyers at ricardo and was like here in florida and together with my partner jason ricardo i help people just like you overcome debt collection with dignity and today i'm going to tell you how to write a letter disputing a debt with a debt collector what that dispute letter needs to look like what you need to put in it how to use it and everything so let's dig in first of all what you need to know is when you're writing a dispute letter you're usually responding to some kind of debt collection you're usually responding to either a letter you've gotten from a debt collector or possibly even a phone call and you are putting on paper your reasons for disputing the debt so first before you do anything you need to figure out why am i disputing this debt what is wrong that i think i need to challenge and there are really two broad categories of things that most people are looking to challenge one is not my account either it's the wrong person or the wrong lender maybe you've been a victim of identity theft maybe they've confused you with somebody else with a similar name whatever it is uh then you're saying okay that's not mine and here's why the second reason you might be disputing a debt is maybe the amounts are wrong maybe you paid it off maybe they've added something that you didn't know about maybe you didn't authorize them to increase that balance or add those fees or charge that item to your account maybe you didn't get the services that they're billing you for if it's like say a medical debt or some kind of service provider or even a landlord or anything else if you didn't get what you're being billed for or the amount is otherwise wrong then you're disputing the amount and you want to ask for proof of that so know in advance which of those two things you're looking to attack and with that in mind let's dig in to what exactly the letter needs to say now if you've seen any of my other videos about dispute letters you'll know i'm not a big fan of form letters and the reason for that is because everybody who receives a form letter knows exactly what it is they know you went online and found something they know that you're not doing a lot of your own research that you're just using something you found online and the answer to that is take whatever you're using and make sure that it is customized to include your specific reasons for disputing the debt now with that in mind knowing the reason we've already talked about earlier i'm going to show you where to find a free form and how to use that form to create the letter that you're going to send to the debt collector to dispute your debt so step one is the consumer financial protection bureau which is a government agency designed to protect consumers in cases like this has a website i'm going to pull that up on the screen now and that website has a list of sample letters that are exactly what we're talking about here so i'm going to put that link in the description of the video so make sure to click through the description get the link so you can find this page that i pulled up right now and you're going to scroll down to the section of where it says the following sample letters will help if you're experiencing common problems and you'll want to click on the first one that says i do not owe this debt and that when you click on that you're going to download a form from the consumer finance protection bureau which has the information in it that you use in order to dispute the debt now remember again there's two general categories of things you might be disputing one is it's not your debt or it's not your account you didn't open that account or maybe the amounts are wrong so let's go ahead and open that form and we will look at exactly what it is you need to do to tweak now i've got the form pulled up on my screen here and this form comes with instructions on how to use it it says how to use the sample letter you're saying this is not my debt and i'll talk about how to customize this letter for the challenging the amount first of all let's look at the instructions one read the background below of course read it we'll go through it together with you two fill in your information we want to customize this letter to make sure it identifies you and your account and your specific debt collection and three you'll want to print and mail the letter and it says here you should consider sending the letter by certified mail or another method by which you can establish when the letter is received by the intended recipient always whenever you're disputing a debt whenever you're disputing anything related to a debt you'll want to use certified mail return receipt you want to get that green card back so you can prove that you sent it and they got it and when so the sample letter here begins on page two and so at the top you know your name return address date debt collector name debt collector address so you know you want to fill in all that stuff so presumably you've gotten a letter or maybe you've gotten a phone call from a debt collector you should have all this information based on the communications you've received usually that's going to be based on a letter that you've gotten so you'll want to say in their dear debt collector name i'm responding to your contact about collecting a debt now it's important i'm responding to your debt collector's contact to me so hopefully you've gotten all that information to fill in here you contacted me my by phone or by mail on a particular date and then identified the debt as for example a credit card with whatever the credit card company is and then here i do not have any responsibility for the debt you're trying to collect i would add that i would go right here so for example i might customize this and say you have the wrong person like so for example if you have a common name you might want to even say that or whatever reason you believe it's the wrong person or you might want to say let's go ahead and correct this i've never had an account with company that would be like if you had an identity theft issue or maybe they've got a john smith it's not you and some other john smith got that credit either way it's it's kind of not me somebody else and i've never had an account with them and so that would be what you say and then it goes on to have the language in there and then you're going to want to say sincerely blah blah blah and it says type in your name and here's what i want you to do do not do not sign this letter by hand just type in your name and so i would type in my name that's it and just boom send it right so what happens if you have the other issue where you believe that it's that while it might be your debt they have the amount completely wrong you would say something along the lines of the amount you are claiming is incorrect please provide a detailed statement of the account so i would change that word debt to amount and then i would also note that this letter does one other thing stop all communications with me at this address and record that i dispute having any obligation the only thing they're allowed to send you then is the proof that you've asked for otherwise they have to stop collecting from you so again you'll want to go down here you'll want to type your name and then you'll want to send that certified mail return receipt so you can prove that you sent it and you can prove they got it that's how you use a form letter so what happens next when you send the letter what happens when the debt collector writes back and says no no we think it's correct i'm going to put a video on screen we got a whole video about what to do
