(ii) in the event a seller files and files a notice of intent to rescind, a counter-offer to rescind, or a counter-offer with a counter-offer expiration date after the original purchase contract expires or contract is otherwise terminated, the original purchase contract or contract, as the case may be, shall be deemed to be not valid and the purchase price shall be returned to the original purchaser.
