Affiant assumes that the seizing agency erroneously concluded that she was guilty of conduct giving rise to forfeiture under La. R.S. 40:2603 or that her property was property subject to forfeiture under La. R.S. 40:2604. Affiant now asserts that she is not guilty to conduct giving rise to forfeiture in that she did not commit an act or omission punishable by confinement for more than one year under La. R.S. 40:961 et seq., nor did she commit any act or omission committed in furtherance of any violation of La. R.S. 40:962 et seq. punishable by confinement with or without hard labor. Additionally, affiant now asserts that the aforementioned seized property was not property subject to forfeiture in that it was not controlled dangerous substances, nor was it furnished or intended to be furnished by any person in exchange for controlled dangerous substances, nor was it used or intended to be used in any manner to facilitate conduct giving rise to forfeiture under La. R.S. 40:2600 et seq., nor was it proceeds of any conduct giving rise to forfeiture, nor was it any interest or security in claim against the property or contractual right of any kind affording a source or control over any enterprise that a person has established, operated, controlled, conducted or participated in as conduct giving rise to forfeiture.
