Whereas, Doe is the owner of property located at _____________________________________________ (street address, city, county, state, zip code), which is bounded on the __________________ (north/south/east/west) side by the property of Smith at _____________________________________________ (street address, city, county, state, zip code); and Whereas, the land owned by Doe that lies along the common boundary of the parties has changed, due to: _____________________________________________ (description of cause of change); and Whereas, the wall that is located on the __________________ (north/south/east/west) side of this land of Smith now serves as a retaining wall for the land of Doe along the common boundary, to the extent of __________________ (number) feet; Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: Smith agrees to maintain the wall on the __________________ (north/south/east/west) side of his property to the extent of __________________ (number) feet so as to provide the land of Doe with the support that it now requires. Doe agrees to pay any and all costs of such maintenance.
