McDade 209-667-2300 (04-25-06) MEAL BREAK WAIVER FORM FOR EMPLOYEES WHO WORK UNDER 6 HOURS Note: Employers use this form to record an employee’s desire to waive the meal break when the employee works 6 hours or less. Seek legal counsel if you do not know the wage and hours. (Delete this note prior to use.)INSTRUCTIONS TO EMPLOYEE:If you work over 5 hours a day, you have a right to take an unpaid, duty-free meal break of 30 minutes. Meal breaks must begin by the end of the 5th hour of work. If you work 6 hours or less, you can (but do not have to) voluntarily waive your meal break. Meal and rest breaks cannot be combined together to create a longer break. Nor may meal and rest breaks be taken at the very beginning or the end of a shift so that the employee essentially begins work late or leaves work early. If you do not waive a meal period, you must clock out at the beginning of the meal period and clock back in after the meal period ends. If you want to waive your meal breaks whenever you work 6 hours or less, sign below. WAIVER:[Option 1 (preferred), work schedule is anticipated because employee waives lunch every day> I understand that I have an absolute right to take a 30-minute, duty-free meal break if I work over 5 hours in a day. However, I desire to waive my meal breaks if I work less than 6 hours in day so that I can go home earlier. Therefore, I hereby waive my right to take a meal period on those days that I work 6 hours or less in a day. Because the Company has a need to anticipate my work schedule, I agree that if I decide that I want to take my meal break on any particular workday or for every workday in the future, I will inform my supervisor in writing in advance that I want to revoke my meal break waiver for that day or for all workdays in the future.[OPTION 2, work schedule is not anticipated because employee can waive lunch whenever he wants by not clocking out> I understand that I have an absolute right to take a 30-minute, duty-free meal break if I work over 5 hours in a day. However, I desire to waive my meal breaks if I work less than 6 hours in day so I can go home earlier. Therefore, by not clocking out for lunch I am electing to waive my right to take a meal period on that day. If I wanted to take a lunch, but was unable to clock out because of work, I will write on my timesheet that I missed a lunch, along with an explanation of why the lunch was missed.
