IN THE CIRCUIT COURT OF COUNTY, MISSISSIPPI PLAINTIFFVS.NO. AND DEFENDANTS INSTRUCTION NO. You are instructed that there is one claim of liability due to negligence applicable to each Defendant. The Plaintiff has alleged that the Defendant in addition to manufacturing and selling an unreasonably unsafe product was negligent in the manufacture, placement of warnings and inadequacy of warnings and that, in addition to its warranty liabilities and liability as a seller of an unreasonably unsafe product, , was negligent by the conduct of its agents in the sale of the wrong size guard for the shaper that it sold to the Plaintiff. In considering these additional claims of liability against those Defendants, you are instructed that negligence is the failure to use reasonable care. Reasonable care is that degree of care which a reasonably careful person would use under like or similar circumstances. Negligence may consist either in doing something that a reasonably careful person would not do under like or similar circumstances, or in failing to do something that a reasonably careful person would do under like or similar circumstances.You are instructed that even if you do not find that the Defendants, or either of them, were guilty of negligence under the facts presented, you should nevertheless consider the liability of each Defendant under the other instructions given by this Court.
