I. Employment. The Church employs the Employee as a bookkeeper and the Employee accepts such employment in accordance with the terms and conditions of this Agreement. II. Term of Employment. The term of employment shall begin       , and extend (Date) to       , and automatically be extended for successive periods of       year(s) each (Date) (Number) upon the same terms and conditions set forth in this Agreement unless this Agreement is terminated by either party as provided in this Agreement. III. Duties of Employee. The duties of the Employee are generally described as follows: A. Carefully and accurately keep such books of accounts and prepare such balance sheets and records and perform such other duties of a similar nature as the Church may from time to time direct. B. Observe and comply with all lawful directions and instructions by and on the part of the Church, and use (his/ her) best endeavors to promote the interests of the Church, and not at any time do anything which may cause or tend or be likely to cause any loss or damage to the Church in business, reputation, or otherwise. IV. No Other Employment. The Employee is required to refrain from acting in any other work capacity or employment without having first obtained the written consent of the Church. It is the Church's intention that the Employee devotes all of the Employee's work effort towards the fulfillment of the Employee's obligations under this Agreement. V. Disclosure of Information. The Employee agrees that any information received by the Employee during his employment, which concerns the personal, financial, or other affairs of the Church or its customers will be treated by the Employee in full confidence and will not be revealed to any other persons, firms or organizations. The Employee is expected to work at least       hours per (Number) day and       hours per week, Monday to Friday. The Employee will be entitled to       paid holidays each year plus (Number)       personal days. The Church will notify the Employee as much in advance as (Number) practical with respect to the holiday schedule. The holidays which are generally observed by the Church are as follows: New Year's Day, Washington's Birthday, Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day, Thanksgiving Day, the Friday following Thanksgiving, and Christmas Day. Additional holidays may be allowed in connection with holidays which fall on weekends. 2. The personal days are to be scheduled in advance to the mutual convenience of the Employee and the Church. Such personal days must be taken during the calendar year and cannot be carried forward into the next year. 3. The Employee will not be entitled to any personal days unless the Employee has been employed for a period of       during (Minimum Employment Period) the calendar year. If the Employee has been employed for less than the required time, the Church may, in its own discretion, allow the Employee a reduced number of personal days. B. Vacations. 1. Additional time may be granted, without pay, upon approval of the Church. IX. Termination of Employment. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision. XI. No Waiver. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred. XII. Governing Law. This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of       . (Name of State) XIII. Notices. XIV. Attorney’s Fees. In the event that any lawsuit is filed in relation to this Agreement, the unsuccessful party in the action shall pay to the successful party, in addition to all the sums that either party may be called on to pay, a reasonable sum for the successful party's attorney fees. XV. Mandatory Arbitration. Notwithstanding the foregoing, and anything herein to the contrary, any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect. XVI. Entire Agreement. This Agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this Agreement shall not be binding upon either party except to the extent incorporated in this Agreement. XVII. Modification of Agreement. Any modification of this Agreement or additional obligation assumed by either party in connection with this Agreement shall be binding only if placed in writing and signed by each party or an authorized representative of each party. XVIII. Assignment of Rights. The rights of each party under this Agreement are personal to that party and may not be assigned or transferred to any other person, firm, corporation, or other entity without the prior, express, and written consent of the other party.
