Term of lease: the lease may be terminated in any of the following circumstances: by mutual consent of the parties, by landlord giving tenant written notice thereof before its expiration: or (by notice) by an order of the court. 6. Occupancy restrictions: the landlord does hereby prohibit the tenant, or any persons under the age of or otherwise not in compliance with the applicable health regulations to which tenant is subject to and under which tenant resides, from occupying the premises as a resident of this residence and the premises include all structures and appurtenances associated with the premises. 7. Liability: tenant shall be liable to landlord for damages arising out of any breach of any provision of this lease. 8. Other terms and conditions: the terms and conditions of this lease may be amended by the written agreement of the parties, except that: a. In the event of a change of the address for the premises as a result of the assignment of the lease to the new lessee or the addition or deletion of rooming house and nonresidential units, the date of commencement of the lease shall not be changed; and b. In the event of such change in address or changes in the terms and conditions of a unit or the addition or deletion of a unit, the date of commencement of the lease shall be retained if it remains the same in the event of the unit or units being removed from this residence by owner surrender or otherwise, unless the new tenant makes application to the landlord and a copy of copies of the same is included in the written agreement with the landlord for the new tenant. 9. Waiver of landlord's obligations: the provisions of this lease that require landlord to make periodic repairs and the provisions of subsections (a) and (b) of section 9, which relate to the right of tenant to take such action as landlord deems appropriate to the health and safety of its tenants and occupants, may be waived by the tenant if such waiver is in writing made before the commencement of this lease; provided that this waiver cannot be considered to be a default by such tenant as to which enforcement of this lease will be subject to the provisions of section 10. Termination by failure of tenant: any agreement whereby the lease is terminated by failure by the tenant to comply with the provisions of this lease shall not otherwise be enforceable without an order of the court. 11.
