Upon information and belief, defendant alleges that the State of Louisiana is in possession of evidence which was illegally obtained. This evidence will form an integral part of the State's case and consists of certain items, namely: INSERT . 2. The items described in Paragraph l above were seized without a warrant and absent circumstances which would render the said search and seizure of the subject items constitutional according to the pertinent provisions of the United States Constitution and the Constitution of the State of Louisiana. 3. Accordingly, defendant maintains that his rights as guaranteed to him by the Fourth Amendment to the Constitution of the United States of America, and Article I, Section 5 of the Constitution of the State of Louisiana have been violated in that the evidence denominated above and sought to be used against him and in the possession of the State of Louisiana was illegally obtained.
