MATRIMONIAL REGIME BETWEEN ________________ UNITED STATES OF AMERICA AND ________________ STATE OF LOUISIANA PARISH OF ________________ BE IT KNOWN , that on this ___ day of ________ , 20 ___ . BEFORE ME , ________________ , a Notary Public duly commissioned and qualified in this Parish, and in the presence of the undersigned competent witnesses: PERSONALLY APPEARED : ________________ and ________________ , both of full age of majority and domiciled in this parish, who each separately declared that they were joined in the bonds of matrimony on ________ ___ , 20 ___ at ________________ , Louisiana, and that they are subject to the legal regime of community property and that it is their intention to terminate the legal regime and enter into a regime of separation of property, as allowed by Civil Code Article 2329, after judicial approval, and in order to carry out their intention they agree and contract as follows: Article 1 The husband and wife agree to terminate the legal regime of community of acquets arid gains and establish a regime of separation of property as allowed by Civil Code Article 2329, and they expressly renounce all provisions of law which establish a legal community of acquets and gains between husband and wife, whether now or later enacted. Article 2 During the marriage the parties acquired property which was classified as community property under their previous regime. The parties desire to settle and liquidate the community that formerly existed between them, and have agreed to do so as set forth in this agreement. Each party makes this settlement and exchange agreeing that the properties and rights exchanged, transferred, and relinquished are an equal and proportionate division of the property. The parties declare themselves satisfied with the accounting that has been made between the parties and waive any right to further accounting from either the community or the parties’ respective separate estates. Both parties acknowledge that they are responsible for any liability, casualty, or other type of insurance coverage they desire on the property that they acquire under this agreement. The parties waive the production of any certificates which might otherwise be required by law, No title examination has been requested and none has been made by the notary public. Neither party has required their respective attorneys to verify the amounts and value of any obligations and assets herein transferred, each party being satisfied that the representations made by each party are true and correct, and each holds their respective attorneys harmless from verifying the values and amounts of these matters. Both parties further agree to sign any deeds, bill of sales, or other documents reasonably necessary to accomplish the purpose arid obligations of this agreement, and specifically agree to sign and execute any and all papers necessary to effect the transfer of any immovable property mentioned in this settlement. Each party agrees that this agreement may be enforced by specific performance and agree to pay the reasonable attorney’s fees of the party successful in a suit for specific performance. Each party reciprocally, totally and unequivocally releases the other from any claims that one or both parties have or may have that the separate estate of one, or both, spouse has been enhanced in value since the marriage, and releases any claims that such enhancement is a community asset. Each party further releases the other from all claims for reimbursement of separate funds used for any purpose, including the acquisition, use, or improvements of community property or for the satisfaction of community debts. Each party further releases the other from all claims for reimbursement of community funds used for the benefit of the separate property of either spouse. Both parties have agreed as to the value of said property and that the property distributed is of equal value and that no further accounting is due. Both parties represent and acknowledge that all of the above mentioned property has been distributed and delivered, receipt of which is acknowledged, and do hereby acquit, release and forever discharge each other from any obligation, of whatever nature and kind, including warranty, redhibition, insurance and subrogation, in connection with the property transferred.
