NOTICE [_COURT_] STATE OF LOUISIANA PARISH OF [_COURT_PARISH_] PROBATE NO. _________ SUCCESSION OF [_DECEDENT_] NOTICE IS GIVEN that [_EXEC_ADMIN_NAME_], [_Exec_admin_] of the Succession of [_DECEDENT_], is applying for authority to continue the business of decedent, [_DECEDENT_], said business consisting of [_business_descrip_], said authority including the authority to borrow funds for use in said business in amounts totaling no more than [_LIMIT_WORDS_] DOLLARS ([_Limit_$_]), and securing such borrowings by mortgages and liens or other security interests upon assets used in the above described business in which Succession of [_DECEDENT_] owns an interest. An order authorizing [_exec_him_her_] to do so may be issued after seven days from the date of the publication of this notice. An opposition to the application may be filed at any time prior to the issuance of such an order. By Order of the Court,
[decedent] may make such terms and conditions as he or she may deem advisable and may give such instructions to executadmin as the court may deem advisable. [decedent] shall include the names, addresses, and titles of the persons to whom or on whose behalf it is proposed that [execadminname] will do business, and such other information as the court may deem necessary, with each application. If the [decedent] is an individual only, the [execadminname] may apply at any time, and upon order of the court, the executadmin shall be authorized to act as a business agent for the [execadminname] as well as for the [exec admin]. Any person interested in the business of decedent may intervene in and be involved in the application for authority. Upon the application of the [execadminname] for authority, the executor shall have the right to inspect and copy any documents, or any part thereof, to which [exec admin] may be a party. If the [execadmin] is a corporation, the executor shall be authorized to do business, which the [exec admin] is unwilling to do, on behalf of the corporate entity, without the authorization of the directors of the corporate entity. However, any person interested in the business of decedent or executadmin shall have the right to intervene in any of the matters in which [exec admin] may be a party, including the appointment or removal of [exec admin]. 3 [execadminname] shall be authorized to inspect and copy any documents, or any part thereof, to which [exec admin] may be a party. If the [execadmin] is not a party at the time of any examination or copying, the executor, at the request of any interested person, may obtain from the court a copy of any document, including all relevant schedules and schedules of interest of the interested person. The executor is entitled to demand such additional information as the court may deem necessary and the executor is authorized to request from the court all documents and schedules which may be necessary in the inspection or copying of which such demand was based, and the copies ordered. The executor is also entitled to inspect and copy any documents which may be held and used by [execadminname], and the executor may inspect and copy any materials, including records and data, on which [exec admin] relies to validate his or her authority for the business of [execadminname.
