Notice to Owner - Missouri law requires that any original contractor who provides labor, material, or machinery for the improvement of property shall provide a notice to the owner of the property being improved. The language of the notice is set out in Missouri statutes and the providing of this notice to the property owner is a condition precedent to validity of a lien in favor of the contractor. Missouri statutes require this notice to be provided prior to receiving payment of any kind. Lien Claim - According to Missouri statutes, "It shall be the duty of every contractor... within six months after the indebtedness shall have accrued to file with the clerk of the circuit court of the proper county a just and true account of the demand due him or them after all just credits have been given..." The Lien Claim filing must be verified by the oath of the lien claimant or some credible person for him. Affidavit of Contractor Certifying Subcontractors Have Been Paid - This Affidavit of Contractor Certifying Subcontractors Have Been Paid form is for use by an original contractor on a particular project to acknowledge and certify that all subcontractors, laborers, or materialmen of the contractor have been paid in full for all labor and materials used in the construction of the project, except those listed. Assignment of Lien - This Assignment of Lien form is for use by an individual lienor who furnished or supplied labor, materials, or laborers for the purpose of improvements of real property, such that the lienor is entitled to a lien for the value of labor, materials, or laborers supplied, to provide notice that he or she assigns his or her claim and lien with all the rights and remedies under law to which the lienor is entitled subject to all defenses thereto that might be made if such assignment had not been made, for the purpose of filing and for the enforcement of the lien.
