Becoming a new resident of a new home state often involves the reorganization
of your legal affairs. This form is a guide to help you in meeting various
requirements, such as voting, driver’s license and vehicle registration
requirements.
VOTING REGISTRATION REQUIREMENTS -
In order to vote in the state of West Virginia, you must meet the following
requirements:
You must be a U.S. citizen.
You must be a resident of West Virginia and the county where you
register.
You must be at least 17 years old and 18 years old before the next
general election.
You must not be currently under conviction for a felony, including
probation or parole, or a court ruling of mental incompetence.
You must register 21 days before a specific election to be eligible to vote
in that election. You may register to vote by one of the following methods:
o In person at one of the following registration offices:
County clerk's office at your county courthouse
Driver’s license offices
Public assistance agencies
Agencies which serve people with disabilities
Marriage license offices (at county clerk's offices)
Military recruiting offices
o By mail by requesting an application from your county clerk or the
Secretary of State or by downloading a mail-in registration form at
http://www.wvsos.com/elections/voters/registernow.htm . If you
register by mail, you must take your driver's license or other ID and
proof of age to the voting polls the first time you vote.
You must provide proof of physical address, such as a driver's license,
utility bill, bank statement, paycheck or other government document.
DRIVER’S LICENSE REQUIREMENTS -
You must apply for a West Virginia driver’s license within 30 days of establishing
residency in West Virginia. You do not have to obtain a West Virginia driver’s
license if you are in the armed services of the U.S. in the performance of official
duties.
In order to obtain a West Virginia driver’s license, you must meet the following
requirements:
You must not be a habitual user of alcoholic beverages or be addicted to
the use of narcotic drugs.
Your license must not be suspended or revoked by West Virginia or any
other state or foreign jurisdiction. If you have previously received a
violation in another state, you must satisfy any citations and suspensions
you may have pending.
The Commissioner of Division of Motor Vehicles must not have good
cause to believe you would be hazardous to the public safety or welfare
when operating a motor vehicle.
You must not be under 18 years of age and not enrolled in or graduated
from an approved educational institution.
You must provide a valid school enrollment form if you are under the age
of 18, which can also be used to fulfill your residency requirement if it
contains a physical address. If the school enrollment form has a P.O. Box,
you must provide two additional proofs of residency from the residency list
below.
You must provide your social security number. If you are not eligible for a
social security card, you may use an Individual Taxpayer Identification
Number issued by the Internal Revenue Service. If you are not eligible for
either of these, you must submit a denial letter from both the Social
Security Administration and the IRS.
If you have never held a license or ID card, or if you are transferring a
license from out-of state, you must present the following documents:
o Certified birth certificate.
o Social Security Card/Individual Taxpayer Identification Number.
o Two proofs of West Virginia physical address from the approved list
of residency documents.
If your name has changed, you must also present an original or a certified
copy of a certified marriage certificate, divorce decree, or court order.
If you are an immigrant, you must provide:
o One of the following documents:
An INS Form I-551 Alien Registration Receipt Card
A valid Temporary I-551 stamp in Foreign Passport (with
English translation) or on INS Form I-94
Valid re-entries permit INS Form I-327
o Social Security Card or Individual Tax Identification Number
o Two proofs of West Virginia residency
If you are a non-immigrant, you must provide the following documents:
o Social Security Card or Individual Tax Identification Number
o Two proofs of West Virginia residency
o A valid foreign passport with English translation
o A form I-94
o A visa issued by the U.S. if you are from a nation whose citizens
are required by the U.S. to obtain a visa.
o All original INS documents to verify status and length of authorized
stay.
o A form I-20 and a written verification of attendance at the school
listed on form I-20 (if your status is F-1 or F-2).
o Written verification from employer (if your status is H1-A, H1-B, H-3
or H-4).
o A form IAP-66 and written verification of attendance at the school
listed on form IAP-66 (if your status is J-1 or J-2).
You must be a resident of West Virginia and show proof in the form of one
of the following documents that shows your current physical address:
o Utility bills with a West Virginia residence address
o Property tax bill or receipt indicating a West Virginia residence
address
o Mortgage documents or homeowner insurance documents for a
West Virginia residence or proof of West Virginia home ownership
with a West Virginia residence address
o W-2 Form not more than 18 months old with your name and West
Virginia residence address
o Weapons permit with a West Virginia residence address
o Motor Vehicles registration card that contains a West Virginia
residence address
o Voter’s registration card with a West Virginia residence address
o School enrollment form if you are under age 18 with your West
Virginia residence address
o Homestead tax exemption with a West Virginia residence address
o Proof of West Virginia public assistance with a West Virginia
residence address
o Residential rental and/or lease agreement with a West Virginia
address
If you have a valid, non-expired license from another state, you must pass
a vision test, complete a brief alcohol awareness course and surrender
your out-of state license. If your out-of -state license is expired, you must
take the vision, written and road skill examinations. If you do not have
possession of your out-of-state license, you must obtain a certified driving
record from the state in which you where previously licensed. If your out-
of-state license is suspended or revoked, you must receive a “clearance”
in the Problem Driver Pointer System, the national driver registry designed
to track violations and suspensions from state-to-state.
If you are under the age of 18, you must take a written examination.
VEHICLE TITLE AND REGISTRATION REQUIREMENTS -
As a new resident of West Virginia, you must have your vehicle titled and
registered within 30 days of establishing residency.
In order to register and title your vehicle in West Virginia, you must meet the
following requirements:
If your vehicle has more than one owner and the names are joined by
“and,” both owners must sign the title documents for a sale or transfer to
be legal. If “or” or “and/or” appears between the owner’s name, either
owner can sign the title document as the seller or purchaser of the vehicle.
If your vehicle is new and has never been titled, you must present a
manufacturer’s statement of origin (MSO) and a completed title application
(DMV Form - 1-TR).
If your vehicle is used, you must submit the previous owner’s title, signed
over to you. Both the seller and the buyer must sign the back of the West
Virginia title.
If your vehicle is titled in another state, you must submit the out of state
title properly reassigned, along with an application for title (DMV Form - 1-
TR). If you do not have a title because you are still making payments and
there is no change in ownership, you must submit:
o A completed form DMV Form - 1-TR (Application for a Certificate of
Title)
o Insurance information which lists an insurance company licensed to
do business in West Virginia
o A completed odometer disclosure statement (DMV Form TM-1)
o A letter from the lienholder stating they are holding a title along with
a copy of the title and lienholder’s correct mailing address
o Title fee of $10.00
o Lien fee of $5.00
o License plate fee of $30.00
o 5% privilege tax on current The Automobile Red Book loan value
If you purchase a vehicle from a licensed West Virginia dealer, the dealer
may accept your fees and submit the fees to the Division of Motor
Vehicles on your behalf. If there is a lien on the vehicle, the dealer is
required to collect the proper fees from you and apply for the title on your
behalf. The dealer may transfer your license plates, or may issue you a
temporary license plate, both of which are valid for 60 days.
If you purchase a vehicle from an individual, or purchase a vehicle from a
dealer without a lien, you may apply for the title and registration by mail or
in person at one of the Regional Offices or at one of the privately owned
license services.
You must submit a separate odometer disclosure form, unless:
o The title is a new “Conforming Blue Title” printed after January
1991.
o The vehicle is ten or more model years old.
o The vehicle is non-motorized.
o The vehicle has a registered gross weight or gross vehicle weight
rating of more than 16,000 pounds.
You must maintain insurance coverage issued by a company licensed to
sell insurance in West Virginia in the minimum amount of $20,000 for one
accident, one injury; $40,000 for one accident, two or more injuries; and
$10,000 for property damage.
You have ten days from the date you title your vehicle to obtain a West
Virginia inspection.
